California Changes Its Rape Laws

California has eliminated its statute of limitations for rape and other sexual-assault charges—in a major change to its criminal code.

The measure, proposed by State Senator Connie Leyva, a Democrat from Chino, eliminated the state’s 10-year window on prosecuting a broad set of sex-related crimes. Governor Jerry Brown signed the measure into law Wednesday alongside dozens of other bills. Full Article

Why not other forms of physical assault? Just sexual assaults? After so much time, how can anyone prove anything? I believe in equal application of a law. Selectively choosing targets to create new laws is not only stupid, it seems to me that it could be challenged. I mean, consensual sex could later turn into an accusation of sexual assault. Nasty break-ups and divorces often does include this type of accusation.

This is because of Bill Cosby situation isn’t it? Damned politicians sign anything to look good. America’s favorite dad suddenly has all these woman coming out saying similar things after all these years. That doesn’t sit right with me.

I was physically assaulted in high school by my peers, and thus to this day I hate bullies. Had this law been retroactively applied and scoped to include all forms of assault, how the heck would I prove it? It’s just another damned feel good law that will do nothing to actually protect anyone.

Stupid politicians.

With the way they’ve relied on circumstantial evidence and vigilante jury’s, these days, they should be able to swell the registry easily now. Great day for justice.

Yes I would like to see this apply to other laws, like when an event happens to a child or teenager and the parents fail to sue. Insurance companies and governments get away with so much because of their statutes of limitations. I would like to sue the state of Michigan for putting me and my sibling in an abusive foster parent home. But I guess only certain people get these rights, equal protection is a joke along with the rest of the us constitution.

The article says basically if your a victim over 10+ yrs ago (rape) happened you can now come forward…

So since the regular SOL (Stat of lim) is 10 yrs… this law basically in 10 years takes effect from something (a rape) that happens on 1/1./17 so you can now get CAUGHT on 1/2/2027..

maybe a good law yes…

but basically DOESNT take effect till 10 yrs and 1 day after it was made (that the statue of lim doesnt exist) Good going lame politicians….

Does anyone now notice how LAWS that now are starting/being made are NOT Post de facto )or whatever its called) cause the US GOVT knows they are being challenged on everyone !

Maybe these idiots are getting tired of having their laws being stripped down to nothing before they can be implemented. I still don’t understand how they got away with adding punishments for decades and why that has yet to be resolved. It’s like there is a contest to see who can come up with the next punishment for RSO’s. There are so many bright minds within our ranks that seem to be wasted due to the restrictions placed upon us. It is so very sad.

you have to remember the government is a living breathing thing that can adapt and overcome any obstacles put in front of it…the big difference is that the government lives forever and can by its time and enact laws that violate the Constitution but will be practicality ignored since they won’t take effect for years or doesn’t really affect people right now…it’s called encroachment for a reason…but of course it’s hardly encroachment anymore it’s just blatantly violate constitutional rights with impunity

Lol, all u have to is watch the tv series law and order and you can see why the laws are being changed. The people who write these episodes are brutal. They act like their so concerned about people, and endorse vigilantism routinely. They say things like did the decease deserve to die. Clearly, we all deserve to die, we all do. But we are supposed to help people, make life better for everyone. Instead, this tv show advocates who has a right to help, or to live. There is something wrong with these people. Children watch these shows and only understand things like a bullet in the head, no sympathy. Its this nation that needs help, it feels victimized by everything. A tragic way to claim it represents freedom, understanding, love. A truly disgusting television show, that by the way routinely violates the us constitution.

Seems that people who are victims of assaults that did not include a sexual element are not being equally protected under the law.

An assault is an assault and I can promise you that a man having his face smashed in with a hammer during an assault will not be ok with this law as he is not protected as much as a man who got his dick sucked at 16 by his 20 year old sister.
