FL: Judge imposes 100 years in prison for child porn possession for first offender claiming innocence

A 36-year-old St. Johns County man is looking at spending the rest of his life behind bars after Circuit Court Judge Howard Maltz sentenced him to 100 years in prison Wednesday morning. People commit crimes resulting in someone’s death (murder, manslaughter, etc) and get a fraction of that sentence. How is 100 years for possession of illegal pictures not cruel and unusual punishment? F-ing ridiculous.

This judge and the Prosecutor should both resign. To hand someone down a sentence FOR PICTURES what a murdered may not even get is a Disgrace of a USA justice system, a damn joke if you ask me. Kudos to the clever person who lied to the judge years ago and claimed that possessing free images creates a market. So possessing free goods from a yard sale, increases those yard sales and the market of those yard sales? There is no comparison to be made between any ‘markets’ and when something is Free. There is NO reward to the original possessor of that good. On top of that, this case involves a peer to peer program, which you usually have no control over what files it shares. Thus, you are not an Active sharer. Of course, understanding this would take more competent people than the justice system currently has. There is No Justice in this case, only a disgrace. We’re moving backwards to medieval times in this country, at least when it comes to things like this.

It seems that all the Red states especially in the South are determined to keep passing tough laws on registrants and are punishing registrants very harshly to make belief that it will keep families and children safe and secure and that they don’t care as long as the system works the way they want it to be.

Any registrant who can legally leave Florida, but who refuses to, shall be sentenced to the crazy laws of Florida, FOR LIFE.

I’d be somewhat–though not wholly–surprised if this sentence isn’t overturned on appeal, FL or not. Don[t y’all get it? We’re the same pariahs drug people were in the 80’s when they all got life sentences for even minor crimes. Light users got worse sentences than traffickers, etc. Common sense WILL come someday. Someday.

Florida is really bad about playing the it’s not a “victim-less crime” card in regards to this stuff.

The way i see it… he’s either going to die in prison, or be castigated and witch hunted on the registry the rest of his life all the way up to hospice.

Either way, the rest of his “meaningful” life is significantly diminished, if not over.

It just goes to show that the judicial system in this country is entirely a plea bargain system. The accused was offered 5 years in prison but because he chose to go to trial, he wasted the States money ( i.e. their pensions, and funding for other resources) so he gets punished beyond even the minimum sentencing. These aren’t sentences handed down to deter crime per say, but to deter the next person from having the audacity to demand a trial.
The American justice system has morphed into something quite atrocious.
This will likely get overturned .

Given the way technology is today, someone raised a comment on the blog on whether it was possible the father who had that stashed on the computer if it was a family computer. My thought is did someone else plant it from outside the family because they could if they had the know how and means to do so. I don’t know more than topically of these peer to peer systems, but it would seem there is more that needs to be done here. I would have to question a lot more here, but the sentencing in the end is absurd and a show by the DA and Judge for political gain as I read it.
