NARSOL is a national advocacy organization that defends and protects the interests of citizens convicted of a sex offense. We are acutely aware that this is a very serious subject and in no way condone sexual abuse. But we are also aware that culture, politics and policy over-react when creating proportional sanctions for these offenses. A large portion of our membership is comprised of family members of those convicted of a sex offense. They have seen first-hand the brutal and unfair treatment of their loved ones.
It is clear that CDCR has unilaterally added blanket exclusions from family overnight visits for inmates with a sex offense conviction. The general logic that CDCR cites for supporting overnight family visits would certainly apply to “all” inmates. No authority is cited justifying the exclusion. This is both troubling from a due process point of view but also raises the question as to what other CDCR exclusionary policies have been promulgated which have no supporting evidence or data.
As a mother there is nothing my child could do that would prevent me from wanting to see, hug, comfort and support them regardless of what they may have done, or have been accused of doing. And for most all parents this unconditional love begins at the time of conception until death separates them. As a sister who had a brother die at an early age and then watched our parents grieve the loss of their child, it is unfathomable to me that CDCR is allowed to put into affect any policy that would prevent any inmate from the support and love of any family member who would want to see and share time with their loved one. Now if CDCR true reasoning is that they are concerned about protecting victims of an offender well there are already many avenues of safeguards to prevent that from being a justified reason of preventing family visits that include any and all immediate members of an inmates family.

Are there any plans to file a equal protection/ due process violation in regards to those restricted from family visits? Cdcr doesn’t do anything unless compelled to by the court or legislators.
