The Unethical Dilemma of an Offense Based Sex Offender Registration and Notification System and the Indiscriminate Effect on the Low Risk Offender

[floridaactioncommittee.org – 3/26/20]

The Law Review article linked to below was written by Kenneth H. Browning, a third-year law student at Barry University School of Law. He examines ethics in the sex offender registration scheme and questions whether it is ethical to sweep up everybody into a common dust bin.

Yes ethics play a vital part in everything. Sure we all can have unethical ways and means but who uses the good, bad, or the ugly in many of these encounters that seem to be more of a vain enticement. Yes it does put a strain on all today that are mixed up in these ordeals.

This article is well worth reading to understand the legal “history” of the registry.
However the “religiosity” of this argument (especially the ending/ summation) seriously blunts the over-all impact. Of course automatically labeling and putting over 800,000 Registrants on the scrap heap forever denies society the benefits of all the possible good they might have contributed.
The author (rightly) argues for tiers based upon conduct but then says the indelible prejudice continually whipped up in the general public collapses these gradiations (even in states that don’t formally adopt the Adam Walsh Act) and label offender forever a “predator” and treat them as though “once a sex offender always a sex offender” perpetrator (or about to be perpetrator) of unspeakable crimes and thus fair game for the lynch mob. I live in a state where the atty General rode this prejudice until she got elected to the US Senate. Janet Mackie

Easiest platform to guarantee work, funding, bi-partisan support, public praise, social media glory, you name it.

Besides the registrants themselves being the obvious losers you can spot all the other losers. “Good” judges that are aware of the system’s faults and end up looking “soft” on crime when they chose to go against the grain. Public defenders. Advocates. Even the families of the defendants. Basically any person or organization that choses to side with logic, reason, and/or constitutionality rather than joining in on the rso bashing agenda.

That’s why people need to stand and BE the present minority rather than the absent opposition.

Janet I like that refreshing view as it presents truth and values in a lot of this unethical situation, I even like the seriously blunting over-all impact that you presented. Even the degree that some go to in this teir level degree is a bit shaded or overstated like some term paper one writes in college with mixed standards.

You even brought up once a sex offender always a sex offender. Sure I argue with my sister as she is always wanting to justify everything like someone from green acres’ but when I mentioned to her to let God get the victory she said well let God get the victory. Is this mother nature ordeal we alll face today some dust bowl of an Oklahoma nature or does respect seemed to be overshadowed in government theories.

Sure government is good if all come together and understand one another but who is putting to many eggs in one basket as in some war of deception that government seems to play on all sex offenders in many encounters. View’s are good and getting to the root of things can leave others views in the dark. Yes we can all stand our ground for ethics and understanding, and working out ordeals is a basic part of human behavior that is so constructive that mankind seems or government overlook today. Who likes suprise attacks.

Janet Mackie One can’t even understand why some pick on Nancy Pelosi whether its good or bad I think the lady has some brain power.
