CA: Coalition of district attorneys files legal challenge to new state prison good conduct credits

A group of district attorneys from across California are joining forces to challenge new emergency state regulations that could expand good conduct credits to the majority of state prison inmates.

Forty-one elected district attorneys — including Lake County District Attorney Susan Krones — filed a petition with California Department of Corrections and Rehabilitation Secretary Kathleen Alliso to request the repeal of temporary emergency regulations awarding additional good conduct credits to more than 76,000 state prison inmates, or nearly 80 percent of the state’s prison population.

The district attorneys said in their announcement that the regulations were passed under a claim of an emergency and first made public on Friday April 30, at 3 p.m. The regulations went into effect on Saturday, May 1.

They said the regulations would result in the early release of some of California’s most violent criminals including those that committed murder, rape, child molestation and arson.

But if someone does prison time at the state level in any state and/or in the federal system and does not have a life or death sentence it doesn’t matter what offense or offenses they were convicted of, plead guilty to, or plead no contest to they should automatically qualify to receive good time credit as long as they behave well in prison. Setting aside wrongful convictions which do happen and if proven should grant someone extra relief there’s still the issue plenty of offenses as written not matching what really happened. Just because someone was convicted of arson, murder, child molestation, or anything else doesn’t mean the facts automatically match the stereotypical conception for that offense. Statutory rape is still rape under the law, but there’s a huge difference between a 17 year old and an 18 year old in a relationship who had sex and a 45 year old having sex with a 17 year old. Sure the same relationship argument could be made, it just will be met with far greater criticism in the case of the 45/17 year old.

@ab I would like to see how many false fabrication sex crimes by rouge police detectives are there . I bet the number would make peoples heads spin . Why do you think all the anti cop shit is happening ? It’s because of what I mentioned . It’s not only sex crimes which are the most easiest to fabricate and to convict but other crimes like drugs , and robbery. It’s a freakin joke ! People are waking up because it’s affecting them and love ones and they are fed up .

Reminds me of episodes of Bait Car; where cops set up a car running in certain areas and wait. Some people were actually moving the car and had no intention of joy riding.

The DA office sounds piss all those people they worked so hard to lock up are getting out faster than they thought they probably feel stupid after telling the victims that their attackers have been put away for along time and you never have to worry about them hurting you again 5 years later hes back liveing next door.
The California DA office is only doing this to keep pressure on sex offenders this has nothing to do with arsonists or murderers.

Anyway, are you saying everyone would be safer after 10 years instead of 5? It is a simple argument to claim a person might become more dangerous -hardened- after 10 years of prison and I suspect that could be why there are so many more reports of RC in possession of firearms charges.

@aero1. Who they worked hard to convict ? Are you kidding if the dude fits the profile the detective will nail you and convince the DA you are the dude . And back it up with fabricated witnesses to corroborate the bullshit . Please don’t give these wipes an ounce credit .
