KY: Law to make AI child pornography illegal introduced

HENDERSON, Ky. (WEHT) — A bill has been introduced in the Kentucky House of Representatives that would make child pornography illegal.

House Bill 92 says the sexual performance may be by a computer-generated image of a minor; provide that any person convicted of possession or viewing of matter portraying a sexual performance by a minor shall not be released on probation or parole without serving 85 percent of the sentence imposed.

Has to be the worst written article I have ever read. The guy must have written it at 3 am after a bender. Nothing about AI.

This bills will ultimately make for some interesting case law in the future. AI generated product is more-or-less art and only art. It removes the possibility of saying there is an actual victim of a crime associated with the picture or video that was taken provided that the AI is not being asked to generate its content from the seed image of a real person. Therefore, while what they are making illegal, might be considered by most people to be extremely disgusting, it could also be argued that it now has artistic value and is therefore constitutionally protected.

In addition to that, where can the line actually be drawn. Say you generate AI product that you intend to be of an 18 year old but some prosecutor decides they look like they are 14 or 15. Who decides how old they actually are? There are plenty of real people in their early 20s that could even pass for 15. With real pictures and video we can more often find out that they are not illegal because we can often identify the individual in them and when the video was produced. With AI, there is no specific age that they are. Who decides what this age is? Who decides that the 18 year old you generated is or isn’t a very mature looking 13 year old? While producing AI with a 10 year old involved might be pretty obvious, things in the teen years are not and to prove otherwise is almost impossible.

Big Brother is watching, and he’s telling the Thought Police about everything he sees. No unauthorized thoughts well be tolerated!

Nazi’s had laws prohibiting the production and ownership of, “Degenerate Art” as well. They used the same kind of propaganda to sell the idea to their people. “It promotes dangerous degenerate thinking!” This is a staple item within the Morality laws” enacted by tyrannical governments.

Is this any surprise coming from a nation that says controlling a person’s movements and affecting everything throughout their lives isnt a punishment? What you in for? I shot someone, you? I robbed a store, and you? I drew some pictures……
