CA Petitions Filed, Granted and Denied

The total number of petitions filed during the first year was 2,798 according to the California Department of Justice (CA DOJ).  Of that total, 1,442 petitions have been granted and only 30 petitions have been denied.  The remaining number of petitions are pending.

The CA DOJ has reported that 1,306 of these petitions filed were filed by or on behalf of individuals assigned to Tier 1, the lowest tier. Of that total, 665 petitions were granted and 10 petitions were denied.

The CA DOJ has also reported that 1,388 of the petitions were filed by or on behalf of individuals assigned to Tier 2, the middle tier.  Of that total, 777 petitions were granted and 20 petitions were denied.

Further, the CA DOJ reported that 37 of the petitions were filed by or on behalf of individuals assigned to Tier 3, the highest tier.  None of these petitions have been granted or denied.

Drop in the bucket. The entire registry scheme is unconstitutional on 4th amendment grounds and due for a full repeal. Who’s to say most of us are actually telling the police the truth about where we live anyway? And more importantly, they don’t have the right to know. Our privacy supersedes everything else.

kind of scary cuz I’m still pending, I got 2 FTR’s one in 2008 and one in in 2010 wile I was on probation for the fist one still no jail time just added another 3 years probation to the the 3 years I was already serving.
Obviously there was no evidence in both cases or they would’ve sent me to prison but I had a really good job at the time and I was a soul provider for my family so I just took the plea deal even though my public defender begged me not to, Later on in life i ended up getting all my charges reduced to a Misdemeanor and Dismissed so now it’s just a waiting game to see what happiness.
The public defenders office said I’m the only petition in the situation they’ve come across so I’ll keep you guys posted on what happens next

Amazing work Janice, this is all you. If it wasn’t for you all these people would be lifers. Yes, there is work to do and a long road ahead, but we can’t deny the progress. I’m trusting that, in time, the absurdity of CP possession being on tier three will be rectified because of you. Thank you for all you do.

Any feedback or statistics on why the denials?

Good news. It would help to know how many of the denials were due to a technicality, like a filing error.

If you are a registrant who is eligible, or soon to be eligible, to petition to get of the registry I strongly urge you to consider hiring Janice to represent you.

I cannot emphasize enough how much it helped to have her legal services and support during the petitioning process. It is, of course, initially intimidating but Janice was always available with any and all pertinent answers for any questions I had which really helped my peace of mind.

My petition was submitted near the third week of May, had no objection by the DA, and was approved by the court by the end of July. I’m no longer on the state or national registry and all my information from 3rd party sites has been removed.

Again, please consider hiring Janice to represent you if you are eligible to petition to get off the registry, it is certainly worth the investment.

I’m glad for you who can petition, but feel a little envious as well. That and furious that a few photos mean I die on the list while people who tried but failed to molest kids get off eventually.

My petition was granted on April 7 I still have not a letter from DOJ about removing me of the public list. I looked at the site yesterday and I am still there.

ACSOL continues to be concerned that only a small percentage of people who are eligible are filing petitions for removal from the registry. We are now looking for ideas regarding how to reach out to registrants and informing them about the petitioning process. During a recent ACSOL board of directors meeting, we discussed sending letters to registrants as well as using a billboard. Please send us your ideas regarding how to spread this important message.

This time I went in for registration, the officer in charge said I should hire someone capable of looking into why I was put on Tier 3 and see if it can be reduced. Stupid question: can anyone recommend an attorny who would be willing to start there with me?

Mine Petition was. Not good enough for the public defenders office he assumed it would be cause of the history n tier level 3 which was added to discourage me from any attempt to move forward. it died at the publice defenders office.

Filed in April, received my letter early August from the county DA that I was approved and registration will be terminated. Just waiting for the states paperwork to show up in the mail. I used local public defender in Ventura County. Good luck to all.

Does anyone know if after being successful petitioning to be removed from the registry here in California.

Will I be able to move to Nevada or Florida or move outside the country to Costo Rica etc without having to register there? or do we remain on some national list? meaning we are stuck in California forever
