CANCELED! SORNA Regulations Hearing January 13

The judge canceled the hearing in SORNA case scheduled for January 13. 

Instead of a hearing, the judge will make his decision regarding whether to grant the pending Motion for Summary Judgment based upon the written record only, with no oral arguments.

Someone needs to livestream this zoom call for those who either don’t have zoom or would otherwise have to report it’s use.

My personal opinion, and I hope I’m wrong, is that it is going to be ugly for both sides.
I don’t see much coming out of this except that the DOJ will have to strictly revise the current law so that there can be no doubt as to who should have to register and when.

I’m hopeful for the results here, if only we can add to strengthening our argument against the registry. DOJ doesn’t seem to have a leg to stand on here and they were basically phoning it in last time. Even if this just one domino to fall we will make progress. Are we addressing the unconstitutionality of the DOJ to make AND enforce laws in this hearing or is that later?

We need to stand for our rights. The reaction will likely be an amendment or change, they will not stop trying to get their kicks. Michigan is a prime example.

So delay delay and then he decides no arguments? Unless it’s in our favor this is total BULL why not do this long ago?

Well that’s that… who knows how long it typically takes to get a verdict from a judge granting a motion for summary judgment based off written records? Also what would this hear change for the nation, not just California?

The opposition to argument seems to be very convenient. I am hopeful that they acknowledge the unconstitutionality of these enforcements. It’s been over twenty years for me personally. That is absolutely ridiculous by any standard.

Extensive data indicates that the overwhelming majority of registered offenders never reoffend. Registration serves only to create profound problems in employment, which does nothing to promote public safety. It needs to end for most, particularly after years of offense-free living. I hope the DoJ can recognize that this is truly a crisis for registered offenders and their families.

Just got the news that the court date was cancelled. Janice, do you take that as a positive or negative thing. Hopefully the merits are described in the written record.

And any outcome only affects California.

It would be nice if someone from one of the leadership teams of the wonderful organizations working to change these registry laws would go on Mike Tyson’s HotBoxIn to discuss the registry and have a Q&A Session with him and ask him registry questions since he’s on multiple state registries. I remember he got turned back going to Chile one time. He was scheduled to speak for the republicans at an election event for the 2016 trump campaign and the democrats raised hell and republicans canceled him. He’s on at least two registries currently. I wonder if he understands everything he must abide by when he travels. Should he be on the california registry if he’s here more than five days? The registry very much affects him and he may or may not be cognizant of how much it does. A little Q&A could be very informative for him. It would be great to see someone ask him these questions because he is very relevant and has a big audience. Further more he is very well accepted within the mainstream media, appearing on late night shows, in magazine articles etc. Maybe some constructive dialogue could be brought to light out there with his audience regarding punishment after one as served their sentence and how it all evolved and the arse hole justice who sits on the supreme court now, it’s all very relevant to the lies being perpetuated by politicians on all levels, in both parties. The registry disproportionately impacts black and African Americans, but yet you have Karen Bass supporting the revised IML, what a draconian, damn them all. I had to choose between going to visit my mom dying of cancer or my brother dying of cancer because I will not register in another state. It’s a damn shame someone cannot spend proper time with dying family members when they are terminally ill, especially in a time of remote work when I could have easily spent weeks or months with my mom or my brother, but I was forced to choose between one or the other and the visit I did make had to be a brief one. I’m a veteran. I need to get checked for disability, but I won’t even go now given what’s going on at the bases with veterans not being allowed on bases to use their retirement benefits. The punishment, the inhumanity of it, comes in all forms and impacts so many people in so many ways. Just sharing my thoughts, brainstorming, trying to generate ideas, Maybe Invite Mike Tyson to Sacramento ...

Regarding Cancellation: Can someone weigh in on why all of the postponements and then the cancellation??? Is this judge afraid of something? Is this typical? Is this extraordinary? I am hoping for some insight because from where I’m sitting, this does not look good.

This must be a running joke. We were in the same situation over two other cancelled hearings ago.

With all the c**p being pulled these days by the incompetent fools elected to federal government , can anyone say they were surprised by this decision?
I know that for so many , “hope springs eternal”, but I subscribe to a more realistic train of thought. “Life is a b****!”

I guess the “judge” just couldn’t stand the thought of leaving out the months of torture by doing this in the first place. That shows where this is going…

I hope I am wrong, but this seems like a loss for us. Not because the merits but because the only reason you do not want to have oral arguments in a case like this is that you have decided for a group that if they had to do oral arguments would look like a complete fool. My money is on the judge ruling against us with absolutely no reason given.

The judge’s decision to cancel this hearing does not mean that it is more likely that the judge will rule in our favor or in the favor of the government. Instead, it means that the judge believes that the documents submitted by both parties in support of, and in opposition to, the pending Motion for Preliminary Injunction have provided him with all of the information he needs in order to make a decision. In my legal practice, I have had several federal judges make the same decision and the results I received are mixed. That is, some of the judges in those cases have ruled in my favor and some have not. The hardest thing to do is to wait for the judges’ decisions. That is because federal judges do not have a deadline by which to issue their decisions. So please be patient for this judge’s decision. We will notify you as soon as this judge issues his decision.
