The proposed amendments to SORA in House Bill 5679 are:
- Giving sex offenders no more than three days to register or report status changes in person with local law enforcement.
- Requiring offenders to report all email addresses, social media names or other forms of “internet identifiers.” That would not apply retroactively to offenders prior to July 1, 2011, but anyone required to register after that date must comply.
- Requiring all telephone numbers and vehicles used by the offender to be reported. Previously, they didn’t need to report those used on a less regular basis.
- Allowing email addresses, social media usernames and other identifiers to be published on a public sex offender registry.
- Removing prohibitions for offenders from living, working or loitering near school property or “student safety zones.”
- No longer requiring an offender’s tier classification to be included on the public website. Law enforcement personnel who willfully fail to periodically report on offenders would face a penalty.

Very few people in Michigan serve over 5 years for killing someone while driving drunk, and in some cases, it’s a misdemeanor. I do agree with your point and don’t believe there should be a registry.

If you have an attorney, he should know how to file in the trial court for removal (if your sex offense occurred in Michigan). I don’t know which motion he would file, perhaps for a corrected sentence. Most likely it will be entitled, “Request for Removal from the Michigan Sex Offender Registry”. Even if your offense occurred out of state, there should be some action that he can file that doesn’t conflict with Does II. He just needs to be creative. He can always sue for an issue outside of the scope for Does II and request your removal as the case develops getting you off the registry and then dismissing the case as moot. Does II is the exclusive remedy to enforce Does I. This doesn’t bar your attorney from suing on other grounds. If your attorney isn’t willing to be creative, I would go to a different attorney.

Rest assured, if you are on the registry you are “on supervision” no different from probation or parole. If you would like to challenge them on the number of internet identifiers, you are free to do so.

I did legal research in college, so I have developed quite a few motions to be presented in court and have done legal research for various cases in state and federal courts and in courts of appeals and state supreme courts. I may not be an attorney but you have to remember that paralegals are reading the law 40 to 50 hours per week. Few attorneys spend more than 5 to 10 hours per week reading the law. The paralegals draft most motions and the attorney approves or makes changes and files them. I know how far I can go until I suggest that someone seek counsel. Read my posts, I frequently mention that registrants should seek competent counsel. I have an advantage that I have spoken to several hundred registrants over the last several years.
There are about 34,000 non-incarcerated registrants in Michigan. I never said that 10,000 are off of the registry today. I said that Does II will take at least 10,000 off of the registry. There is no accurate estimate as to how many persons are affected by the Does II litigation But when you think about the number of persons with pre-2012 convictions, you realize that the number will be quite high. I am hoping and believe that this number will go north of 20,000. The 10,000 is quite a conservative number when you think about it. Does II will probably take at least a year before it becomes final. Registrants will not be removed en masse. The state is required to make individual determinations for all 45,000 persons on the registry. The incarcerated ones will probably have to wait. The ones with money for an attorney will get express service. Registrants without funds will have to wait until Michigan makes a determination in their case which could take 3 to 4 years. I am not giving anyone false hope. I don’t care if someone gets angry with me. There is a lot of misinformation on the internet and I am taking the time out of my day to correct it.
I am aware of several registrants who have already been removed from the registry. I have also run into 3 who have had their records expunged after the change in law in 1997. I can’t supply you with their names but can supply your attorney with them. You don’t have to worry about any future litigation or legislation. If your case is pre-1995, you only have to wait for Does II to become final and they make an individual determination in your case.
I’ve only read through the proposed legislation a couple of times but haven’t thought about it enough to form an opinion. The ACLU wouldn’t be opposed to the bill unless they put serious thought into it. If the ACLU is opposed to the bill, then it most likely is a bad bill.

In Texas an attorney for clients has filed suit as a Breach of Contract where the SOL was applied retroactively (and in the view of any reasonable person this is purely Ex Post Facto).

Thank you for your email regarding HB 5679, a bill that makes changes to the Sex Offender Registry Act (SORA) in Michigan. I appreciate you taking the time out of your day to make me aware of your views.
HB 5679 was passed last week by the House and the Senate and has been presented to the Governor for a signature. I voted in support of this bill as it addresses the main issues from recent law suits that invalidated the registry as to all offenders convicted prior to July 2011. This bill also deletes the “school zone” prohibitions found in the current act, amends the current reporting requirement timelines, prohibits the listing of a registrant’s tier classification on the public website, and exempts homeless registrants from having to maintain a driver’s license. Overall, HB 5679 ensures compliance with the U.S. Constitution and the federal Sex Offender Registry Notification Act.
SORA was first established with Public Act 295 of 1994. Many changes have been made over the years to adapt to changes and challenges that arose. I will be sure to keep your concerns in mind should additional legislation be introduced to make further changes.

You also want to get down on this Detroit person views or was it somewhat of an upset stomach emotion/reaction of his viewpoint. Myself I can take it or leave it. I myself am nobody special but with faith, and hope in a higher power I’m sure we all look for a rainbow. @Saddles…I agree with you. I try to respect what others believe, as long as they don’t try to “force” their beliefs on me or others…by violence, or some other coercive methods. And as for not believing in the Creator, or perhaps “religion,” per se, there is an old adage that goes like this… “If you don’t believe in something, (or Someone), you’ll fall for anything.” Through-out this entire SORA ordeal (24 years and counting), I have tried to keep a uplifting attitude, for myself and others. I pray we all will see good things happen in 2021. Peace and grace be with all of you.

I have been helping people on the registry for several years. I have learned that most persons on the registry are quick to complain but no where to be found when it comes time for action. Look at FAC. 22,000 persons on the Florida registry and 2,000 members. But how many “members” are engaged on a regular basis? How many “members” donate to their various issues? Most likely, FAC is composed of a few dozen individuals who give their time to the cause and perhaps a few hundred who donate on a regular basis. These are the ones doing all of the work and their loved ones deserve to be taken off of the registry. The rest as far as I am concerned, are not motivated enough to get off of the registry and deserves whatever inconvenience the registry entails.
I personally know of several people who are no longer on the registry in Michigan, some of whom I have helped personally. I am not worried about the ones who will be taken off through the Does litigation because they will eventually be removed. FAC is aware of persons taken off the registry. You sit there and ask for “proof”. The reason we won’t provide your “proof” is because we will not publish the names of the persons removed which will destroy the very reason for their removal. Your comment shows how removed you are from the people who are actually in the fight. You show yourself to be one of the fools who are all mouth but no action. If you are on the registry, you deserve to be. We who are in the fight will continue to fight. You need to crawl back into your hole.
665 one more thing I should add, we can all get upset at the price of tea in china as one may say or even with this registry crap. Sure some went to prison with this registry and some didn’t, why? Some went thru a hell on earth and some took this punishment or penalty like a man or woman if thats the case. Are some that Ku fu fighter or are some people a quitman or do we just want to learn. Many things commented on here should be taken with a grain of salt. Yes we all shold defend this issue and stand up. Yes their is a reason for all season. Many look at this registry in many ways and believe much of this registry is unnessary and holds one in bondage in many ways and yes we all want to shut it down as it does one no good. So should we all press on for true justice or just learn to understand this complex issue is no good.
Some people can take the scriptures to different teir’s or levels. Those views were even presented in Jesus’s time, Daniel’s time and it has been on going in many ways. Why we even still have race war’s today. Myself I even live 30 miles from Charlottesville, VA. And yes many in scripture did serve many Gods and their were “Sin” sacrifices. Should we all take a look at the penal system and even the justice system today or would that be going a bit to far when we are all talking about this registry ruse. I’m sure Michigan has its problems and frankly I don’t know to much about the state or even why some call it the mistake on the lake, and I don’t even listen to Guns’ and Roses but I do have a viewpoint as many others to share to you Detroit. Can we all be a busybody at times and not even understand our own actions. Now the word action can be used for a positive type action or negative action. If we all had a positive action we wouldn’t be incased in all this would one. Yes it is said Actions speak louder than words but is it the actions of authorities or the actions of the one caught up in the action by this precept.
Should one take a look at authorities or ones actions before they call the kettle black. Sure helping is good but who gets out of a mouse trape when the bait is cheese. Maybe we all should go back to Of mice and men and learn a bit more. Sure we can all get sick of its all about the database theory’s or if porn is more addictive than drugs to inflame this registry type of scheme or should we all say talk is cheap.
Are we all reasoning together to come to the conclusion for ones mindset or should we let our conscience be one’s guide and who control’s that or upsets that in many of these registry issues. Much of these ordeals did not involve children or teens and the one’s that did involve child can be just as upsetting or are we all here to upset the apple cart instead of gleening to understand much of this registry ordeal is wrong or are we all missing the point.

It sounds like you are from Michigan. I just got done talking to a registrant in Ogemaw County with the same issue. The judge signed an order about 9 months ago barring Michigan from enforcing registration until covid is over. When will that be? No one knows. You are smart to ask. What I tell everyone is to call the registration office at least once a month. The Ogemaw County Sheriffs told this guy that the registry will not be enforced before June of 2021. This deputy may know something we don’t but you don’t want to risk an FTR. Call the registry office at least once per month until things return back to normal.
I went in my local cop shop, at the beginning of December, which is like 100 yards or less from my Apartment, and Bree the clerk said to me, ” Bobby you already know we are not registering anyone, unless you want to register I will be more then happy to to put you in the system, but you are not required to right now, so I said I was just checking, said see ya and left” I live in a small town been here my whole life 51 years , most people in either related to or a family friend since my great great grandparents were one of the first people to settle here in 1778. Anyway I got off the topic, sorry , so Bree told me I don’t have to register unless I wanted , so I left. So the order is still in play.

Thanks R33. I have run into several registrants that say the police aren’t enforcing the registry against pre 2011 registrants. The ACLU says for everyone to stay compliant but many police and sheriff’s departments are telling pre 2011 registrants they don’t have to register. With the federal court blocking enforcement of the registry, things are really getting confusing. I go along with the ACLU’s recommendation that everyone at least try to register until Does II becomes final.
Well I have been nervous about not registering since last February since I’m not pre 2011. I went on map registry and checked to see if I was on noncompliant list and I’m not on it. So if you’re worried about it you can go and check to see if you are on it.

You’re smart to keep registering. If you managed to stay out of jail for 30 years, you must be doing something right. The good news is that you should be off the registry after Does II becomes final, which should be in 2021. So there is light at the end of the tunnel.
