Anyone depressed and feel hopeless?
Has there been any word on the progress for having 311 changed from tier 3 to a lower tier? I saw an article here that said they were working on this but no update since.

In the recent Supreme Court ruling on the EPA, the court used the Major Questions Doctrine to help settle the case. The MQD says that “extraordinary cases involving matters of great economic or political significance, federal agencies must be able to point to specific Congressional authorization for their actions.
Is it possible that the MQD can be used in our favor against the SORNA regulations?
I have a question for our attorneys here. I was granted a dismissal, PC1203.4 on my felony charges in November 2021 by the Judge here in San Bernardino County. I submitted and received my live-scan information from the California Department of Justice – DOJ in May 2022. How soon are they “supposed” to enter your dismissal into your file so you can see it on your Live-Scan? Second, as long as my dismissal is still not listed on my Live-Scan, am I still or now subject to SORNA regulations and requirements. As long as my dismissal is not listed, I would think I still have a problem with SORNA. and 3rd/finally, why do DOJ play their games like this one, – oh yeah, because they can and do get away with it. 🙁 . Thank you. p.s. we, (my attorney, who is awesome), did petition for removal from Tier Registration and currently going through the required steps
I just had police show up to my door for the first time in 12 years.
They were doing a “compliance check.” What a load. They wanted to harras and had all my information in a little manilla file. They wanted to enter my home without any warrant or pretext to spare me “embarrassment.” But felt free to say “we’re here to check on your sex offender registration” in the breezeway. Last I checked, embarrassment wasn’t a pretext for violating the 4th.
The worst part is not only do these sorry excuse for officers wanted to ignore my 4th amendment rights and CA Article 1 Section 13 rights by hand waving PC 13887.1 in my face, but they actively implied I was hiding children in my apartment! With no probable cause or any proof! Loud enough so anyone nosy enough in the building could’ve heard. If they had read PC 13887.1, a(3) states “harassment against registrants may cause them to disappear and attempt to live without supervision…which would defeat the purpose of sex offender registration.” PC 13887.3 (a) states “to identifying, monitor, arrest, and assist in the prosecution of habitual sexual offen.” I have had one case 12 years ago, that hardly counts as habitual!
Thankfully, my wife and inlaws were home, so I have 3 other people there. But I am absolutely livid!
The best thing that happened is when I looked in the officers face and said “you are violating my rights and everything you need is in that folder.” Man looked like a boy with his hand caught in the cookie jar.

Question. So I moved from CA to NV, my case was 288.4(b), which I received my 1203.4, when I initially registered in NV, check back in 90 days to know what my tier level is? I found shortly after that I’m assigned as Tier 2. I can’t afford an attorney, public defenders wont help me, I lost my job after a month of working because i’m on the website, and i’m afraid that once my landlord finds out I will be evicted because it states it in our lease.
With that said, the case worker told me that I am a Tier 2 because AWA has a provision of close age. Because victim was 17 yo and I was 32 yo, that my age was over 5 years in closeness. I have to register under AWA. I can’t find anything that states what the case worker mentioned.
Is this true?
Ah, I’m watching news coverage of yet another mass shooting. I’m wondering if anyone thinks there is anything wrong in Amerika these days? I don’t know. I think there are too many people that actually love this kind of drama. There is a lot of blabbing going on about the shooting. As typical. But I don’t see anything changing. Amerika loves hate. Amerika loves their Registries and segregating, marginalizing, and ostracizing people. Registry Assholes/Supporters/Terrorists should understand that they are complicit in all of it. They are a public safety problem and threat to freedom. Oh well.
I read a short article recently titled “American patriotism hits a new low“. The last sentence of the article is, “The Point: All of these numbers point to a startling reality — the ties that bind us together as a nation are loosening with every passing day.” If Amerika keeps its Registries and keeps f*cking around with them, I guarantee it’s all going to get worse. Obviously.
Regarding compliance checks, for the life of me I still can’t figure out how they are constitutional without cause to believe that any given registrant is out of compliance at the given time.
I know of no other class of ex-criminal or civil regulation that imposes compliance checks. I’ve never heard of LE going door to door to verify that no one has murdered anyone, possessed illegal drugs, driven drunk, burglarized, or committed any other crime. Compliance with the law is presumed with any other type of crime absent proof to the contrary. In fact, they are searching for status offenses in that the laws they proactively seek to enforce aren’t even crimes but for registry violations – status offenses.
I am not persuaded that compliance checks are constitutional just because a sheriff and/or legislature authorizes or requires them.If the courts are going to cling to the idiotic notion that FTR isn’t part of ongoing punishment from the registry because it is a separate offense, then as a separate offense it should require cause to authorize LE investigation.

Of course sex offenders are excluded from help from the victims of crime funds. They make us a target and are unwilling to even bury us.
Does anyone know of a list of states Where a CP offense for just possession, not production Would not be a public listed on the states Website? With California doing all Tier 3 and pubic, Looking for other states to maybe move too. I heard Oregon would be ok and Washington state maybe, but does anyone else know or live in a state that they are not public for a CP offensive?
I went to my SJPD and asked if I could register early ( 3 wks) because of someone coming out for my birthday and we are going backpacking.
The officer was very nice. Asked when my regular date was, if anything had changed from previous annual, and allowed my to. She then asked where I would be going and to have a great time.
I asked her name and told her I was writing a letter to dept praising her service. She said not to include her deviation from the rules, but that I deserved a nice B’day. WOW!

Don’t know if anyone has covered this yet but this will be helpful to all those who will be ending up in a halfway house. Most HH wont let you access their computers or have a smartphone. They are going off of your probation release orders so all you have to do is get approval from the probation office and you will be able to use them.

I ask because I sought help from V.A. They prescribed medication but after almost 3 months I had no change and what’s worse is they didn’t bother following up.
I’ve been told by different clinicians that they don’t think I have the type of depression that medicine could treat, since it isn’t a chemical issue , but a environmental one. I am constantly told, “ Change your situation and you’ll feel better”. NO S*** Sherlock! Needed a degree to figure that out?
I am starting to understand the idea of “self medication”. Just get stoned and drunk enough to forget all this. The problem is I don’t do either at all.
I understand that we know our situation far better than any doctor ever could, but it would be nice to be able to wake up just once without looking for a rope to throw over a branch.
Oh, as to my interview at Philippine consulate? They denied the work visa request from the company offing me a position, but I was told they would be willing to re address it when I am off registry. Not surprised, but still disappointed. The job was a nice opportunity.

So now for some good news! I would like to take this opportunity to publicly thank Janice Bellucci. I retained her to submit my petition for removal from the CA registry. I was informed yesterday that my petition WAS granted! I am no longer required to register in California! It took nine months for this to happen and Janice kept me in the loop at all times. She is fantastic to work with and I can not recommend her enough!

I have been wondering about this. Very few of us have ever mentioned that our offenses overlapped our careers. That being said, why is it that licensing ( I lost my state license ) or employment in general is so affected by this. 90% of the public never brings home to work or work home. Take Alcoholics as an example. I have had coworkers over the yrs that got DUIs and were sent to court ordered rehab that I never knew even drank. They performed fine at work. Yet we are pushed out of our jobs mainly because of the public’s uncomfortableness with the term “offender”. Maybe if we labeled them “Alcohol offenders”………
This is another peripheral affect of the registry. Even with a private LE registry, we could likely go about our occupations without our offense coming into play. Why does my CP conviction make me unable to do my job. The registry makes it sound like we are all overwhelmed with sexual thoughts 24/7 and therefore can’t function. The airlines for instance allow alcohol abusers to continue flying airlines with hundreds of passengers everyday once they get the blessing of some for profit rehab facility, yet even with a critical pilot shortage, airlines will not hire back experienced pilots that looked at CP, or touched someone inappropriately once 8 yrs ago. Tell me, when was the last time you actually met the pilot that flew the plane. It is rare. My point being personal contact is unlikely.
The registry is therefore taking highly trained, highly experienced people out of in demand positions at a time when those same people could be helping with likely zero chance of re offending.
Obviously each case is different, and I understand why a serial offender is removed, but that is not my point. The registry needs to consider the individual.
I think (for now) the registry should be set up where we have a tier system, but within it, a person could petition for early termination. Like going in front of a parole board. For instance, a tier 2 has a mandatory minimum of at least a tier 1, yet can then petition after that time for a review. Basically no set time for each tier other than the tier below it. Allow the people running the registry (CASOMB) to hear cases instead of a judge, who has possible prejudices, or a prosecutor with an agenda. This way the person’s life as a whole can be taken into account. Their contributions as well as their efforts to turn the page post conviction. Isn’t this what a 17b is anyway? Or early probation release? Shouldn’t we be judged by a group of our peers? This way the offender can at least get a chance at returning to their profession if granted early termination.
All I know is if I had a brain tumor and the only two people available to operate were a resident alcoholic and a dismissed CP offender, guess who I’m choosing. Certainly not Mr. (or Ms.) shaky hands, that’s for sure!

I am throwing out a challenge to all that comment here on ACSOL. Let’s see if we can go for a week without negative comments. I have read some today and the tone is rather disturbing. in the past I have been guilty of the same negativity when it comes to my situation. Maybe not with the viciousness with what some of you bring, but unproductive none the less.
We can all agree that the stories posted her paint a rather dark picture of how society sees us. We might even be able to relate to some of them. Maybe ACSOL could try and post a few more positive articles if possible.
But it’s summer, and most of us have trips planned, or at least some time scheduled with others. Maybe a baseball game, a picnic or a drive up ( or down) the PCH. Let’s all put the anger in a box for a while and try to be normal. If not for yourself, then for those you care about. And if being angry at everything is normal for some, then maybe staying off the site for a week could be good medicine for you.

Hey guys. I just got the dreaded California DOJ Exclusion Letter. Ugh!! I’ve been happily living, started my own business, and almost married come September in Croatia. Today I received the letter, stating “I am no longer able to be excluded from the Megan’s Law registered. And “no sooner than 30 days, I will be listed back on the registry.” I am 1 year from my 10 year, tier 1 offense of misdemeanor 647. Texting a 16 female client who I thought and told me she was 18. So “molesting a child” misdemeanor. Horrible way to put it. Though the real charges are “annoying a minor!” A misdemeanor. Please just some support. I hope people don’t look me up and now I have to move out of our house of 8 years and uplift my whole family and friends.
Janice…should I register as transient to help or would that even make a difference. Also, I get regular visits, where I live in San Diego on the clock. They are very nice; ranging from sheriffs to city politicians. Kinda strange. I am in full compliance and always have been.
I can not wait for my one year. Next year. Also, Janice, my charge was in November 2013. Do I have to wait till November 2023? Thanks again.
