The new hearing date is now set for Sept 12, 2022 at 9:00 am Pacific Time.

Stip to Continue date for hearing on PI motion – Aug 2022

A hearing is in a federal district court to discuss a motion for preliminary injunction in the case challenging the SORNA regulations that became effective earlier this year.  The hearing will begin at 9:00 a.m. in the U.S. District Court, which is located at 3470 12th Street, Riverside, in Department 1 before Judge Jesus Bernal.  The hearing is open to the public.  The hearing is  expected to be accessible via the courts Zoom Webinar link

The motion for preliminary injunction was filed on behalf of ACSOL and an unnamed individual plaintiff on June 3.  The government filed its reply brief on Jun 24.

“The court’s decision regarding the motion for preliminary injunction is expected to be significant,” stated ACSOL Executive Director Janice Bellucci.  “If the motion is granted, it could stop enforcement of the challenged SORNA regulations nationwide“.

At least one attorney from the Pacific Legal Foundation, which filed the SORNA regulations challenge, will present an oral argument in this case during the Aug 29 hearing.  The judge may or may not rule on the motion during the hearing.

Please keep on your mailing list! Also I won’t be able to get on September 12, I have couple of doctors appointments, that I can’t change! I hope you record it, I would really love to hear what he has to say? Our ministry writes to a lot of S.O.’s in different state’s and wow seems like DOC and Governor, doesn’t want them to succeed in life! It hurts our hearts to see this happen to them inside and outside, where they are under the gun persay! I just cry, California isn’t any better!

The poor overworked Asst. D.A. Has a scheduling conflict. Well poor D.A.s. Of course we should all be considerate and allow them to drag out our lives, disrupt our schedules and put our lives on hold indefinitely because they can’t hold to a mtg they agreed to a month ago. Maybe if THEY were thrown in jail for 30 days for simply missing an appointment, they could understand what we go through EVERY F*ING DAY OF OUR LIVES! Or maybe a fine for each delay. Or maybe a written apology to each PFR for dragging out crap.

I’m considering starting a betting pool. I’ll bet that by the end of next week there will be an announcement that the hearing will be rescheduled to September 26. Any takers?

The new hearing date is now set for January 3, 2179 at 9:00 am, Pacific Time.

Pure fear. This will be a monumental loss for this US Attorney. His/her resume will always bear this defeat. I’d be afraid too!

 “Assistant U.S. attorney has a scheduling conflict.” That is code word for they do not have a leg to stand on. 

Maybe they want to wait until after the midterm elections? …[Politicians] don’t like being the party of “the courts ruled our laws are unconstitutional”… An injunction on a (presumably) popular law isn’t a big deal, but this just might be their SOP when recent legislation is facing serious challenge close to November. That said, delaying hearings just seems to be what all American courts do, all the time.

It seems like this web site does not like posting critical reviews and I am beginning to think posting here is a waste of time. I was critical of the plaintiff attorney bending over backward to accommodate the government, never objecting to the delay requested by the government. I expressed an opinion that the attorney should bend over backward more for their client. It is true I used the full word meaning BS, but was that the reason it was censored or was it the criticism?

PA: HUGE WIN!!! – SORNA Declared Unconstitutional (From FloridaActionCommittee)

YES, you read that correctly. A Pennsylvania Trial Court has declared SORNA Unconstitutional.
The court wrote, “we find that SORNA is unconstitutional as a legislative scheme in both its use of a constitutionally infirm irrebuttable presumption and the punitive effects of its registration and notification provisions, as well as in its application to this Defendant, who has a strong support structure, is educated, is working, is an excellent candidate for rehabilitation, and is highly unlikely to reoffend”
The Court also found that “based on the evidence of scientific and academic consensus presented, we find that SORN laws do not have the effect on recidivism and public safety anticipated by the Legislature, and that they are not rationally related to the purposes for which they were enacted.” This is one of the first cases (to our knowledge) where the scientific and academic studies have been considered and used in formulating the court’s decision.
