To the Forum –

Vote! If can vote, then get out and vote if you have not already done so via mailed ballot or other early voting. Your voice needs to be heard through your votes. Many of us who are part of this forum made sure you have the ability to vote by time in uniform.

If you cannot vote for whatever reason other than your choice not to, then work the system to where you and others who cannot vote are able to! FLA is a mess currently for those who should be able to vote cannot because of politics, so work the system in those other states, which there is more than just FLA, to make it so all can vote.

I don’t care what your politics are and it is irrelevant to this forum overall, but vote.

Fellows the ordeal of the church and the preacher may be a big deal to some. One might say I’m in good company with David, Moses, and some of the Old Testament characters that committed some acts like this, although its not the end of the world. They didn’t ask me to leave the church by no means as that would be like asking a prostitute to leave also and I’m not to partial of wearing a dress.

The point that I am trying to make is the principle of the whole ordeal. Anyone that looks at that roster or registry is going to come to their own conclusions. One can either think inside or outside of the bun but that is a form of human discrimination. So were does love thy neighbor issues come in.

We have discussed here in the forum previously the power of the federal gov’t to do as they please and not always for the good of the people. This case was a chance IMO to put things back in some order in a way things could be challenged on behalf of the PFR in the future.

Listening to the media talk about the election and the effect it is having leaves me wondering. They are saying that groups are under threat from vigilantes, having to take their kids out of school and even relocate to protect themselves……..Welcome to our world people. Sucks, doesn’t it.

Tim n WI… If I was going to get you a book for Christmas would A theory of justice be better which was on the best seller list back in the 70’s and I’m sure that would be better than understanding this database computer crap.

My understanding is that convictions for CA penal code 288(a) are not eligible for relief under code 1203.4.

Now that some of us have managed to get off the registry, we may now be eligible for the new 1203.425.

I would appreciate it if ACSOL could add this discussion to the monthly meeting, and maybe give us some guidance on taking advantage of this. Especially, if it could aid interstate or international travel.

Sigh of relief—looks like Whitaker will be the governor of Michigan for 4 more years. With 7 more years of registration left for me (both as a Tier 2 in Michigan and under Federal SORNA) this means it will be unlikely there are any major changes to the state registry before I’m off. Separate question—does anyone know the email address toll for the Does III case which was soliciting evidence for harm caused by the registry? It suddenly dawned on me to simply investigate whether any state hiring policies use the registry in tandem with a normal 7 year criminal background check for other felonies—that’s evidence right there, from the horse’s mouth. If the state itself admits that it uses the registry to vet employees, it’s admitting registrants are treated differently than other felons and the registry is a unique stain on the reputations of registrants.

Add another one to the list of countries creating a registry.

Some days I should just know not to come here , I just end up sad or so angery I cant see strait , this registry is getting PFRs murdered , and the ones not being murdered are just dying from stress /sadness or kill them self , can’t even talk to people on this page anymore , can’t even tell if anyone even hears me any more , 30+ and counting , from just filling out a card , mug shot , finger print , out the door , now a stack of paper work, and felony if you do not comply , and more coming , a lot to handle when just wanting to move along

Circling back to the new PC1203.425. I understand that it excludes PFRs from the AUTOMATIC conviction record relief, but it also says that one can still petition in the old fashioned way. Those who are not PFRs just don’t have to actually petition for this relief, it will be automatic. So, those who have already earned the traditional PC1203.4 should benefit from the rest of the new law as stated. Per this law, commencing January 1st, 2023, for any record retained by the court pursuant to Section 68152 of the Government Code, except as provided in paragraph (4), the court shall not disclose information concerning a conviction granted relief pursuant to this section or Section 1203.4, 1203.4a, 1203.41, or 1203.42, to any person or entity, in any format, except to the person whose conviction was granted relief or a criminal justice agency, as defined in Section 851.92.  The term “criminal justice agency” means a State, local, or tribal— (A) court; (B) prison; (C) jail; (D) law enforcement agency; or (E) other agency that performs the administration of criminal justice, including prosecution, pretrial services, and community supervision. Paragraph (4) has no mention of PFR status either. So, with that said, come 1/1/23, it should be illegal to disseminate information for anyone who received conviction record relief, regardless of whether it was received through automatic relief or through petition via 1203.4. Megans Law is NOT a criminal agency!!
This, along with CA’s right to privacy, this needs to be addressed ASAP.

I plan on visiting Southern California for 4 days soon. I can’t really figure out what my registration duties would be in California as a visitor. How long can one stay without registering?

I wish i had me some attorneys that will fight as hard for me to get off this damn registry as hard as Nikolas Cruz’s attorneys did for him not to get the death penalty, after he murder 17 children and adults. While he sat there in court coloring in coloring books. SMH.

These views and comments about this 10 yr. old boy are good, bad, even speculation at best but its still two wrong don’t make a right in this “hands on” issue. Blame it on the parents sounds like justification, blame it on the situation, sounds like a cop out, blame it on carnal knowledge now your getting somewhere. We are all tempted in many ways.

I have a question if anyone cares to chime in. My question is if i received my court order with my petition granted, that means that that day! The order was signed by the judge, from that moment onwards I no longer have to register? Even if the DOJ has not updated it yet? I have properly notified my registration office and showed them the court order and they made copies. From what I read on the DOJ site it says “ Your requirement to register in California ends at the time the court grants your petition” so that’s it! Right?

State enforces sex-offender Halloween ban
There is so much wrong with this. Should we have “Lock in” for thief’s on Black Friday since they might be more attempted to steal? But for some reason Halloween incarceration is legal in Arkansas

SB 731, the bill to seal the records of those convicted of crimes after 1 July, 2023, is passed. There is a question of if it applies to RSOs.

Based on my reading, it does not benefit any RSO who was:

  1. Convicted of a felony
  2. Was required to register as a result of the conviction.

Ergo, I conclude that if you were convicted of a felony offense and required to register, your records will not be sealed, even if you are relieved of the duty to register.

That is fairly clear upon research. What is unclear, is how this would apply to a person whose case was subsequently reduced to a misdemeanor, post conviction. From my take, it would not aid such persons, but here my knowledge is fuzzy and I cannot find a clear answer.

It’s similar to the topic of firearms. Again, if your conviction is later reduced, is your right to own a firearm restored? (I was also told by a Deputy DA that RSOs may not possess firearms. However, he sounded uncertain when pressed on the question, so I am not sure.)

As usual, there are many people who fall into gray areas because legalese is difficult to translate into plain English, and because all kinds of things happen in the courts which creates a lot of unique cases. Although lawyers understand such things clearly, most people don’t get direct answers from lawyers unless they are paying customers. The media frequently lacks understanding and does not write with enough clarity, precision, or consistency to answer these questions reliably. Often, they take a quote and post that, but the quote is generalized “This will help millions of felons!” but does not make important distinctions for people in certain categories.

Anyway, sharing what I’ve worked out so far.

For those who have previously indicated interest and/or intent to emigrate to Turkey, recent info I have learned may give pause. I cannot reveal the source of my information other than the person is in-country and I have direct communication with the person.

Recently, my contact and others have tried to renew their visas. With very few exceptions, visas are being denied. New visa applications are also being denied. If a visa is denied, a foreigner has 10 days to exit the country.

There’s a woman who lives there most the time but came back to the US for personal reasons. Her visa expired while here and normally it would be no big deal to re-up and go back. Not this time. No visa, no entry into the country. The problem for this woman is she owns property there and cannot sell it without 1) being there herself or 2) granting power-of-attorney to someone to sell it for her. The hitch? She can only assign POA in person in Turkey…where she is not allowed to go.

Also, of late there has been a lot more police activities throughout the area my contact lives. Large presences here and there. Also, travel between provinces is being clamped down, with huge fines for taxi drivers, etc., who do not check residency cards, passports, etc.

From where I sit, it appears Erdogan is cracking down on things, for reasons not yet obvious. I suspect some of it is due to the war in Ukraine (just across the Black Sea) and some of it is due to the ongoing unrest in Iran (next door).

The long and short of it is that Turkey isn’t a consistently reliable place to live. Without permanent residency or a golden passport, one could get kicked out at any time, with little advance notice.

I’m sure many on here want to be a Nancy Drew and understand this registry. Hey your gonna have your negative’s and positives in life so is it better to be imprisoned with oneself or is someone in CA wanting to find the mother load in this registry of trial and error ordeal.

Sure pressing on for a good cause is good but at times its not expedient. While things are not as simple as one would like things to be we all have hope. Does government cover up issues? Even a sentence of 600 yrs is a bit out of line but it still makes a dramatic impact statement on others. Fighting for a cause is good if its the right cause and is done with moral understanding and good ethic principals.

 Many speak out on many issues. One wonders today if women wear the pants or are men just going along with the hot pants gala. I thought the registry was to keep men from talking to a teenager but its more than that and the American public doesn’t even have a clue as to what really goes on. The trickery of greed is so evident that real justice is the sad story of it all in America today.
