ACSOL Conference Features Challenge to SORNA Regulations

ACSOL’s conference will feature a presentation on Sunday, October 15, regarding the pending lawsuit challenging SORNA regulations.  The presentation will be made in person by lead attorney Caleb Kruckenberg of the Pacific Legal Foundation.

“Significant progress has already been made in the lawsuit that challenges SORNA regulations,” stated ACSOL Executive Director Janice Bellucci.  “Attorney Kruckenberg will share with us at the conference the current status of that case as well as his future plans which could lead to a decision by the U.S. Supreme Court.”

The SORNA regulations being challenged became effective in January 2022.  They require individuals to comply with federal, not state, requirements to register including multiple registrations per year.  

ACSOL entered into a memorandum of understanding with the Pacific Legal Foundation (PLF) in April 2022.  In that document, PLF agreed to lead and finance the litigation and ACSOL agreed to serve as lead plaintiff in the case.

PLF filed the initial lawsuit in federal district court in May 2022.  Subsequent to that filing, several motions have been filed by both parties.  The most important motion so far was a motion for preliminary injunction which the court granted in January 2023.  The court’s decision prevents the SORNA regulation from being applied to registrants in California.

“We continue to believe that the judge will broaden the current motion for preliminary injunction beyond California,” stated Bellucci.  “We are encouraged by all of the judge’s rulings in this case including a recent decision to deny the government’s motion to dismiss part of the case.”

It is still possible to sign up for the ACSOL conference that will be held on Oct. 14 and Oct. 15 at Southwestern Law School in downtown Los Angeles.  The cost to attend the conference is $75 and that fee includes lunch on both days.

Attending this year’s conference is a great way to get early and first hand information regarding the lawsuit challenging SORNA regulations. Lead attorney Caleb Kruckenberg is the presenter and he will answer your questions in real time.

Times like these I wish I lived in California or nearby to attend in person, however I’m on the east coast near the swamp.
