The Alliance for Constitutional Sex Offense Laws (ACSOL) filed a lawsuit today in a federal district court challenging in-person registration requirements of both the City of Fresno and the County of Fresno. The lawsuit was filed in the U.S. District Court, Eastern District of California.
According to the lawsuit, the city and county’s requirement to register in person violates the due process clause of the 14th Amendment as well as the 8th Amendment’s prohibition of cruel and unusual punishment. The lawsuit requests that the court permanently enjoin the city and county from requiring in-person registration until the current pandemic has ended as well as declaring that state law does not require in-person registration.
“ACSOL took an important step today by challenging in-person registration in a federal district court,” stated ACSOL Executive Director Janice Bellucci. “This court now has an opportunity to protect the public, law enforcement officials and registrants from COVID-19 infection by stopping in-person registration.”
Prior to filing of this lawsuit, ACSOL filed lawsuits in four state courts challenging in-person registration requirements in three cities and two counties. ACSOL also filed a lawsuit in the California Supreme Court challenging the Attorney General’s in-person registration requirement. In the Supreme Court case, the Attorney General’s response to the lawsuit is due on May 4 and ACSOL has an opportunity to reply to that response no later than May 8.

ME I’m grinning. How cathartic it is to see you’re using their own sticks to bash them upside their heads. After All can we be living there n a land where law counts, yet doesn’t?
We see more and more laze faire enforcement whereby some laws are enforced and some not, each at the political whims or fiat of the current administration’s personal disposition.
Go for it Janice. Might as well try it regardless of the pandemic too since it seems the panic regarding it appears over.

Does anyone know the current status of “In-Person-Registration” at the Orange County Sheriff’s department. We are due this month, and I wanted to make sure I have the most current information. Their website says that all sheriff’s buildings are closed to the public. Thanks for any input.

Registering in Fresno County/City is the pits on a good day.
During a pandemic, it is certainly life-threatening, especially for those of us with several additional risk factors!
One has to wonder. Was it be silent and carry a big stick or speak softly and carry a big stick. One wonders what it is today. A lot of mixed emotions on this registry ordeal. Well one thing about this registry ordeal Janice explained me several years ago when I wanted to know the difference between an advocate and and an advocacy group. Sure I have a good inspiration for Janice and her team and yes she will carry the ball thru.
Remember this pandermic didn’t come up for nothing as there is a reason for everything under the sun and man can’t even control that with all the science in the world and don’t give me none of this computer stuff or man in the moon theory but who controls emotions of right and wrong or emotions of hurt and suffering. I wonder who is “testing” or trying the spirit today in many of these ordeals?
Sure we have an advocate its Jesus or is that type of grace and truth sweep under the rug in today’s culture. Sure I don’t like the way the grass is growing today with this registry ordeal much less see some child kidnapped. Its bad enought in an adult murder situation or doesn’t one know you have to become as little children.
Seems like we have a President that said “nobody tells me what to do” so who is a prophet today? Who predicts when ecomomy can open up, people can get back to work. Strenous laws are one thing as one person compaired Hawaii to other states.
