How the Use of Improper Statistics and Unverified Data Corrupts the Judicial Process in Sex Offender Cases

We begin this Article by sharing something about our past legal practice careers, as we believe that is so relevant to the topic that we focus on in this Article. When Michael L. Perlin was a rookie Public
Defender in Trenton, New Jersey, in the early 1970s, he regularly visited the Menlo Park Diagnostic Center where some of his clients—those who had been found, in the phrase used then, to be “repetitive and compulsive” sex offenders—were housed.

When Heather Ellis Cucolo was a rookie Public Defender in Newark, New Jersey, in the late 2000s, she regularly visited the Special Treatment Unit (“STU”), attached to the state prison in Avenel, New Jersey, where some of her clients—now classified as sexually violent predators—were housed.

When the two of us talked about our experiences during the latter years, we were stunned at the similarities that we found: almost no meaningful treatment of any sort, prison-like conditions, and a population comprised of a minority of people whom we agreed posed a significant danger to the
community but a majority of whom had committed crimes involving no personal contact. Full Paper (pdf)

Very, very, very poor leadership! Indeed from both sides at the extreems.

What judicial process ?
What we have for a fair, effective and honest Defense is a joke… that’s why we are so heavily burdened to backtrack the courts with such concepts as due process and the plea deals running hand over fist as many as the law can to puuush like all hell is freezing in ng over and get as many convictions as possible and weaken any appeal efforts and give little power to rebuttal or take a stand to clear some charges and lighten sentences !
We’ll with no one guarding the so called guilty the law can just stampede any efforts to have balance, normality or fairness at all !!
Analysis of the current laws, practices and systems say it all in the details…for instance how can we bind the hands of defense laws/lawyers by placing strict 2 yr or whatever the Hell the BS time frame is to file appeals, rebuttals et …I compare this crap shoved down criminal defense lawyers and clients like I do with statute of limitations of hernia implants…who the hell can dictate that all cases bodies are the same , i.e. my surgery did not show signs of problems until after that limit ,!!
So now we see Victims get all the time in the World.. but defense can just shut up and go straight to hell !!
Who in their right mind would agree this is the proper and just way to give all parties an equal and unbiased stance to propensiate all they can in the best interests and regard to clients and to uphold fairness in the judicial system ?

Don’t laugh !!
It is a Police State…
Now they come to check at your home
Now they file FEDERAL charges for stupid, petty things and are able to use Administration Crap to Convict again and again !!
Now Severely over regulated about all kinds of Personal affairs.
Now system locks RC in to Strict scrutiny and forces penalties for all kinds of garbage ,!!
Now laws can impead a wide variety of necessary life functions and abilities as well as personal relationships !!!
HELP JANICE AND ANYONE WE MUST GET A DEFENSE STRATEGY BEFORE ITS TOO LATE !
We can slow or stop in many cases and ways the law is being used to Hurt RC…..Now is the time to Act !!!

O.k. I don’t want to sound nit picky, but since the authors are making the point that very few once convicted of sex crime re-commit sex crimes, shouldn’t they use another term than “sex offender” for those people who never again commit a crime? It just adds to the confusion. How about using “former offenders” or just “people that had a sex crime conviction?”

The scary thing is that “statistics” like the Static-99R scam have become untouchable. No one challenging how flawed the premise of 10 questions “predicting” peoples’ future — which is frightening. But yet government continues to come out with propoganda-like “studies” that go unchallenged and unquestioned.

I am in Missouri was looking up some news today and came across a case law update not sure what to think of it maybe someone with a better understanding can make since of it Basically looks to me that they are admitting how it breaks our unconstitutional inheritance here is the link copy and paste!
