OPINION Jim Dey: Right to be silent while in police custody is golden (Jim Dey, The News-Gazette, Champaign-Urbana, Illinois, Tue, June 13, 2023, via Yahoo.com)

We have discussed the right to be silent (5th Amendment) numerous times here in the forum when approached by LE whether in/on your mode of transportation, in your abode, or elsewhere. Above is an article about the Illinois courts that overturned a lower court ruling who opined invoking your silence is akin to your admittance of guilt. It is not and the appellate and superior courts agreed it is not.

Minimal communication with LE has been encouraged, e.g., “Am I being detained? and Am I free to go?” to protect yourself as well as asking for an atty to stop any interrogation regardless if you have been arrested or not, e.g., “I have been instructed to not talk with LE by my atty without them being present”. It may not get you out of a traffic violation citation on the spot, but silence is truly golden.

In England, a 21-year-old woman was convicted yesterday of sexual assault (BBC link) and will be required to register as a sex offender because she pretended to be a man in on-line and real-world interactions with a 19-year-old woman, and the two kissed (the 21-year-old was wearing a simple disguise). The reasoning is that the 19-year-old is heterosexual, and did not intend to kiss a woman. The conviction is pretty surprising to me, but I wonder if similar logic could apply to many of the stings in the United States, where, usually (but not always), male police officers pretend to be minor females. Could it be considered “sexual assault” to be tricked into having a sexual conversation with someone who is not the gender they claim to be, and you are not attracted to that gender? (This would also work for men convicted of sexual conversations with minor males, but the officer posing as the minor male was female. This is also not about transgenderism, because the typically male police are not transgender and do not identify as women; they are simply pretending.)

You mean the AG wouldn’t have delegated authority has much as they’ve had previously? Possibly the little twerp from the state across from the big apple would have to work more on legislation to screw people?

Has anyone watching DOES III have an update? I noted on my calendar the plaintiff’s facts and expert witnesses closes today. Any idea of a resolve timeline yet? I really need I lifeline to grab right now. Kinda spinning out. Caffeine, weight training and no money to spare is putting me in a holding pattern. I have some family who care, some that don’t, and would love to start over . But that can’t happen so I spin.

I keep coming back to why it is so hard to prove that the registry IS punishment. It is clear as day. Many States have residency or presence restrictions. We can’t travel freely, and by freely I don’t mean that we can’t travel, but we can only stay an x amount of days, and for international travel, we have to give a 21 day notice. We have to register in person within 5 days of one’s birthday, meaning, we can’t be away from home, on vacation, etc during that time frame since we can’t register online. We have to let Law Enforcement know if he switches jobs, or gets a new car. We can’t be on school grounds. The list goes on and on and on.So, again, how in the world are these things not considered punishment as it does not apply to any other EX OFFENDER? This should be a slam dunk.

The following study shows that 20% of minors are producing child pornography of themselves. That’s an awful lot of minors that need to be added to the registry. If true, 20% of everyone in the most recent generations should therefore be on it by the time they reach 18.

Good Morning ACSOL community. Mark Weinberg and Adele Nicholas (during the NARSOL in Action program) suggested we continue to inform people, have conversations, and spread the message to help our cause of ending the registry. The truth is that unless you are on the registry or know / love someone who is, as a general citizen you have no idea how horrific and un-American the entire scheme is. One of the things I’ve started doing is following some key anti-registry / civil rights groups on twitter solely for the purpose of retweeting and liking the message if applicable. I really hate social media, and twitter especially, but if we can use to our advantage we must do it. I know there’s a ton of noise on these platforms, but the more people hear about the registry and the more we plant the seed about how unconstitutional it is, over time people will become more accepting and knowledgeable. Not all people, but we have to start informing the general public to gain support so law makers are less fearful.

I am following: EndTheRegistry, ACSOL, NARSOL (all the RSOL’s) and AmberSpeaksUp who is particularly vocal and well spoken. In addition, following other re-entry advocates (not just SO’s) helps spread the message that people deserve a second chance if they serve their sentence.

Nothing is a panacea, but I like the idea of speaking out to others beyond ourselves. Please respond if you have other channels / vehicles / ideas to help spread the message.

So I see these articles once a week but what irks me about this article is the police department took to Facebook to Warn the Public about these scams. I think we should sue the police department for equal protection standing since we registrants our barred from that public forum so how are we to know about these things if we’re constantly excluded from participating? So they should be forced to put out a flyer in the paper alerting us to the danger as well. I don’t see how they are allowed to warn some of the public but not all of the public.

The AZ legislature sent SB 1583 to Gov Hobbs. This bill will place all PFRs on the public site (level 1 offenders are not publicly shamed currently). This bill is driven by the victim’s advocacy people and will impact thousands of PFRs. Of late, AZ has been ramping up its PFR laws, adding more and more. Please contact Gov Hobbs using this form: https://azgovernor.gov/office-arizona-governor/form/contact-governor-hobbs, or if you do not want to use the form, email: engage@az.gov, and hopefully they will forward your comments to the Governor. Stand up, show up and speak up! AZ needs all the help it can get to stop this new law. The Governor typically signs or vetoes bills on Thursdays and Fridays, so time is of the essence. Please be respectful and use facts. It does not matter if you do not live in AZ. Speaking truth to power is not state-specific. Love to all.

@DR. Thanks for the important update! Finally read somewhere federal lawsuits typical go to trial 12-18 months from filing. We all know DOES III isn’t typical. The state will pushback for as long as allowed, and then some. Yet it’s easier to deal with when there’s somewhat of a timeline.

Gov Hobbs Vetoes PFR bill that would have placed all level 1s on the public shaming website. A governor with a “D” had the courage to veto this terrible bill that the “R” controlled house and senate for Arizona sent to her. Someday, maybe we can get the crazies out of government and have some sense of sanity. Now, if we can just get rid of lifetime probation AND registration (sorry, AZ has no offramps)…

NARSOL is going to be in Houston this weekend. Now it’s like they are beating a dead horse by say the same thing over and over. Looking over there schedule for this weekend I see zero reason why there are here. All the donations they received and we seen zero results. They get on like talk about banning the registry knowing that something that’s not happening anything soon, so why keep wasting time and resources saying it. Why not use that donation money they getting from RSO in Texas and push for
Realistic reasonable legislation? Like giving an off ramp for a first time offender that’s been a BS classified tier 3 on the registry for 30 years an off ramp an opportunity to apply to get off the registry that hasn’t reoffend or had any other felony charges or convictions. How about passing legislation not giving 16,17,18 year olds life sentences on the registry. Take some notes from what CASOMB is doing. Then move on from there. But this smash whole thing is a pipe dream and is wasting precious time.

I have two questions. 1. can a registrant live in a 55+ community in Orange County? 2. If you move within the same county (Orange), do you just register your new address at the police station of the city you are moving to, or do you also have to de-register at the police station where you currently reside?
