The new rules allow students to be found guilty of assaulting a classmate without ever seeing the full evidence against them.
On Friday, the Biden administration unveiled final Title IX regulations, nearly two years after the administration proposed dramatic changes to how colleges handle sexual assault allegations. The new rules largely mirror proposed regulations released last year and will effectively reversing Trump-era due process reforms.
According to the final regulations, accused students will lose their right to a guaranteed live hearing with the opportunity to have a representative cross-examine their accuser. This is accompanied by a return to the “single-investigator model,” which allows a single administrator to investigate and decide the outcome of a case.
Further, under the new rules, most schools will be required to use the “preponderance of the evidence” standard, which directs administrators to find a student responsible if just 51 percent of the evidence points to their guilt. Schools are also no longer required to provide accused students with the full content of the evidence against them. Instead, universities are only bound to provide students with a description of the “relevant evidence,” which may be provided “orally” rather than in writing.
Another good reason for us registrants to only take online college classes!
Joe’s previous boss put this into place years ago and he is only refining it to their agenda after being corrected to a more legal process subsequently. I see universities being civilly sued over this, which is what I recommend, because not sure a court would see it the accused’s way even if the preponderance has been traditionally the standard in this country and could be the lynch pin to undoing this effort, IMO.
When you get railroaded on accusations alone, it’s set up for nothing more than guilty upon accusation. I see so many lawsuits in the future against universities. These kangaroo courts are biased and a joke.
I don’t understand why the “rules” are different if you are assaulted on campus vs off campus? A crime is a crime and should be treated the same no matter where it happens and a college campus of all places should want due process.
Terrible decision.
More Populism in action, this time the leftist version? All comrades agree…accusation equals guilt!
More dismantling of anything that gets in the way of populist goals! Now the Glorious People’s Revolution can eliminate all dangerous counter-revolutionaries from comrade training centers, simply by fabricating a plausible story that seems to fit the facts.
Meanwhile over at the University of the Fatherland… all those that, “Don’t belong” can be banished away through the same process.
Of course banishment from any, will be permanent banishment from all. Works great for all, so long as everyone lies constantly and consistently. Which is what will create the endless attempts to take this away from “them”, while keeping it for, “Us”!
Leftists are certain that the Right will use it to Banish away people of color, LGBTQ+, Non-Christians, etc, wich will happen, and then they’ll have them! They’ll be able to prove the Rights are discriminating and can no longer be trusted… but the Lefts can!
The Rights will continue to accuse the Left of turning Universities in Indoctrination centers, that eliminate Conservatives, Christians, etc… which will happen…which is why the Leftist can no longer be trusted, but they can!
The only thing they will all agree to, is that everybody needs to lie constantly!
Once again, the SO Moral Panic and the hysteria it produces serves all Populist Agendas…. at least for now.
My my, sure is very different then how the Tara Reid case played out: innocent by virtue of power and who you know.
I see a lawsuit in the future. This is plain unconstitutional. Every accused individual has a right to due process, including facing their accuser and being provided with ALL evidence against him.
Sounds like all the work Betsy DeVos did regulating more rights and due process for those accused, is getting stripped away. So many have fought back against against the injustices against Universities with lawsuits in these matters.
