This seems like a lawsuit waiting to happen. How can they detain people who are no longer under probation or parole, regardless of the level?

Seriously, who wants to hang around the sheriff’s office on Halloween. Is he going to offer coffee and donuts? Play board games? Or just stick them in a cell and so the sheriff can go home for the night.

I’m in Georgia. I almost wish I lived in Chatham County just to buck this “order” to see what they do. Nowhere in the Georgia code do I see anything that gives a sheriff any more authority over PFR than anyone else.

That includes those on parole or probation. If the PO ordered it, that would be something else. But the sheriff doesn’t have authority over POs either – the Department of Community Supervision is a state organization and not subordinate in any way to any county.

But I guess this is a little progress. Ordinarily, multiple county sheriffs would have been parading the Halloween harassment of registrants since mid-September. I’m surprised that there hasn’t been this year.

I have read several local and national stories in the press today on protecting kids on Halloween. They all talk about visible costumes, watching for traffic and drunk drivers and mostly checking candy for fentanyl. Nothing about protecting kids from PFR’s. It’s a non-issue. All of these yard signs and illegally detaining people not under arrest are just fear theater–and unconstitutional.

Every year during Halloween, the news and law enforcement talk about how to keep kids safe during this time. Never is the registry mentioned. It is always about drunk drivers, safely crossing streets at dark and spiked candy. So, where is all this hype coming from?
