In addition to ACSOL, two large organizations have formally filed their opposition to AB 1568 which, if passed, could block thousands of registrants from petitioning for removal from the registry. The organizations are California Attorneys for Criminal Justice (CACJ) and Legal Services for Prisoners with Children (LSPC).
Letters from both organizations are similar (see them at the bottom of this article), but not the same as, the opposition letter filed by ACSOL. According to CACJ, passage of SB 1568 would set a dangerous legislative precedent that other elected officials could abuse by introducing new laws each year. As a result, the Tiered Registry Law would be gutted by “bringing us back to quasi-lifetime registration….without a factual or rational basis impacting community safety.”
The focus of the LSPC letter is the potential cost of requiring petitioners to undergo a psychological assessment that evaluates their risk of re-offense. According to that letter, this requirement “would make it impossible for nondangerous indigent individuals ordered to obtain risk assessments to be removed from the registry.”
All three letters of opposition regarding AB 1586 request that all members of the Public Safety Committee vote “no” on AB 1568 during the March 3 hearing. The legislative analysis for AB 1586 is not yet available, however, the analysis is expected to include a list of all organizations opposing the bill as well as all organization supporting the bil. The bill analysis will be posted on this website after it become available.
