Appeals court decision involving an Orange County case could impact thousands seeking to have their names removed from the ‘Megan’s Law’ list.

SANTA ANA – A court ruling involving an Orange County case could result in hearings for thousands of California sex offenders seeking to have their names removed from the “Megan’s Law” registry, says an attorney who represents a sex offender.

California’s 4th District Court of Appeal found unconstitutional a state law that allows some sex offenders to have hearings for certificates of rehabilitation while denying that right to others. Full Article

So did Tirey get a second hearing date yet or did he automatically receive Certificate of Rehabilitation and get removed from the Megan’s Law List ?

Well, I don’t want to sound negative, but I attempted to obtain a certificate of rehabilitation 6-years ago in OC! All of my charges had been dismissed and I was released on SUMMARY probation! Investigators questioned my neighbors, they came to my door at 7pm/I later learned they secretly recorded our conversation, the DA was nuts/angry/accused me of giving her dirty looks, the DA even requested the alleged victim be put on the stand and be questioned/the judge got angry at her and told her no one would allow this and finally the judge stated that he couldn’t find one reason to deny the motion, but it wasn’t enough? Furthermore (this DA pulled all her punches), the DA even subpoenaed my wife to court so she would see this? I literally couldn’t believe what I saw and experienced! On my way out of court, the alleged victim (in front of the DA and investigators) proceeded to make comments towards my wife? I can only imagine what would have happened if I had did the same? OC doesn’t play fair! I lost all respect (my issue took place initially in LA/you must process the petition in the county of your residence) for the judicial system! Even today, its hard to believe! I ran into the DA 2 weeks later in a store 🙂

C, I concur! In my situation, my conviction was (battery) dismissed and its a non disclosable situation. So, if the investigators had made a comment regarding this, they could have been held accountable. ONe neighbor asked me what was going on. I simply told them I was applying for something (a job?) They made really great comments regarding me and my family, but the slime ball investigators simply stated I had no issues with any neighbor. I’m very educated, live in both a very quiet/nice area, now 18 years into this situation and caucasian. When I was going through my process in LA, the DA, Judge and investigators where both very cordial and always professional. I never had any issues. When I went to OC, I was in utter shock. I no longer trust anyone who works in OC. The DA was in my view on the verge of an out of control and angry woman. The Investigator was like something out of a movie/angry/arrogant and he literally wrote anything he wanted on his report. I stated nothing to him. If I was to go it all over again, I would have a document to hand them when they knocked on the door this time, I would simply state call my attorney and we can all meet together and I would have my attorney observe very closely what was going on in the hallways so that he or she could address any concerns with the Judge.
