Court to Rule on SORNA Regulations Motion Without Hearing

The Pacific Legal Foundation (PLF) decided today to waive oral argument regarding its pending Motion for Preliminary Injunction filed in the SORNA regulations challenge.  The decision to waive oral argument was made by PLF after the court delayed six times the date of the hearing on that motion.   In the absence of oral argument regarding the motion, the court will make its decision based upon the extensive written record provided by both parties.  The court does not have a deadline by which to make its decision, which could affect the…

ACSOL Board Votes to Discontinue Support for March 2023 Conference

The board of directors for the Alliance for Constitutional Sex Offense Laws (ACSOL) unanimously voted yesterday to discontinue its support for the March 2023 conference in Washington, D.C.  Prior to that vote, ACSOL had donated $5,000 to the Women Against Registry foundation for that conference. Lawsuit Challenges Tiered Registry Law Provision

A lawsuit was filed this week in Sacramento Superior Court challenging the application of a tiered registry law provision that has resulted in individuals being assigned to Tier 3, the highest tier, even though their felony conviction was reduced to a misdemeanor.  Specifically, the lawsuit is seeking relief for an individual convicted of a felony violation of Penal Code Section 288.2 that was later reduced to a misdemeanor. CA: Number of Petitions Granted Continues to Grow

Source: ACSOL Contra Costa County today granted the first petition under its consideration.  The petition was submitted on behalf of a registrant convicted of PC 288(a) about 25 years ago who had successfully registered for more than 20 years.  Prior to today’s hearing, the relevant registration office determined that the registrant was eligible to submit his petition.  During today’s hearing, the District Attorney’s office stated it had no objection to the petition being granted. “Today was a great day not only for the registrant whose requirement to register has been…
