What Is The Legislative Purpose Of The Registry

Empirical research has repeatedly proven that community notification is ineffective at increasing community safety but rather it excels at increasing collateral and direct damage to former offenders and their families, which is increasing daily as citizens use the sex offender websites as hit lists for vigilante actions against offenders , their families, friends and employers. These vigilante actions range from bullying, vandalism, harassment, assaults and even murder. Also legislators are increasingly abusing their power by creating laws, which often violate the Constitution, that are based not on empirical research or…

Annual Registration

Submitted by USA on 2013/11/20 at 8:35 am I do have an interesting question/point! First, the arrests for not registering within 5 days is tacky. Now, I’ve gone to register early and the ladies (OC) asked why I came early? Lets suggest or pretend my annual registration is supposed to be every December 1st? What if I’m going to France from November 20th to December 20th? Hmmm? Or, lets say I had a family member (daughter attending school in DC) get in a major car accident and I have to…

Sex Offender Was Deprived of Equal Protection, CA Rules

Panel Says Law Allowing Some Child Molesters to Seek Pardon, but Not Others, Is Irrational and Unconstitutional A state law that allows a defendant convicted of a sex crime against a child under the age of 10 years to obtain a certificate of rehabilitation and pardon, but denies a similar opportunity to one convicted of molesting a child under the age of 14, is unconstitutional, the Fourth District Court of Appeal ruled Friday. “[W]e can discern no rational basis for the unequal treatment of these two similarly situated groups of…

Static-99 “norms du jour” get yet another makeover

It would be humorous if the real-world consequences were not so grave. Every year, at a jam-packed session of the annual conference of the Association for the Treatment of Sexual Abusers (ATSA), the developers of the Static-99 family of actuarial risk assessment tools roll out yet a new methodology to replace the old. This year, they announced that they are scrapping two of three sets of “non-routine” comparison norms that they introduced at an ATSA conference just four years ago. Stay tuned, they told their rapt audience, for further instructions on…

CO: Draconian sex-offender laws need reform (Op-Ed)

In 1855, a 19-year-old woman named Celia was executed by hanging in Missouri. Her crime? She had murdered her owner, a man who purchased her when she was just 14 years old and had been forcing her to be his concubine ever since. There was no dispute that she had killed him. She had even confessed. But Celia’s defense attorneys boldly argued that Celia was permitted to use deadly force to protect herself from rape, basing their argument on a Missouri statute intended to protect white women. Elsewhere in the…

Living with 290: Wishing It Wasn’t True

A little background – I am innocent. I was accused and that was enough to start in motion a process that was impossible to stop. I was lied to by my accuser, “victim”, friends, OC Sheriffs and OC District Attorney. I was tricked into saying a few words that were considered a “confession”. OC Sheriffs lied to, assaulted and threatened my accuser to force her “cooperation”. During a later pre-trial, in open court, my accuser and “victim” both recanted. It did not matter. I plead to one felony count on…

Living with 290: 290 since ’93

I’ve been lucky.  I was arrested in 1993 for four counts of 288a. I pled guilty and two were dismissed. I’d made a huge mess of my family and I just wanted to make it right.  I was fortunate.  There was no prison time…. Six months county time, and because I was my families primary means of support, I was allowed to serve that via home detention. That meant my supervisor was aware of what was going on.  There was court ordered treatment, but I began that even before I…

Living with 290: Boy how times have changed!

Being on the registry has not only affected and changed my life in ways that only the 750,000 plus people and families would begin to understand. I got on the registry in 2002. Boy how times have changed! I raised my two children and had primary custody of my son and daughter. Both of them went to a private school up to high school and my son went on to the Air Force. I made good money back then running a mom and pop store for nearly twelve years until…

Sentencing and Prison Practices in Germany and the Netherlands: Implications for the US

Germany and the Netherlands have significantly lower incarceration rates than the United States and make much greater use of non-custodial penalties, particularly for nonviolent crimes. In addition, conditions and practices within correctional facilities in these countries—grounded in the principle of “normalization” whereby life in prison is to resemble as much as possible life in the community—also differ markedly from the U.S. In February 2013—as part of the European-American Prison Project funded by the California-based Prison Law Office and managed by Vera—delegations of corrections and justice system leaders from Colorado, Georgia,…

Living with 290: Things must change

First, as I think back regarding my journey, I can only think about how much I regret putting myself in the situation I put myself in. Today, over 18 years later, I’m still so disappointed. When I initially was referring with my counsel, I was informed (I plead to a wobbler) that once the charge was reduced to a misdemeanor, I would no longer have to register. He confirmed this!I later found out this was incorrect. I went back to court, had the court reduced to a misdemeanor, charge eventually…
