Can someone tell who can help me, pro bono (I’m unemployed), file for the COR in Orange County? Mine was single count (not plead down from multiple counts or a felony) misdemeanor for a violation of 311.11(a). I’d like to file it late this summer
I went thru OC Public Defender’s New Leaf program in 2012, but, as many of you know, as an RSO, I needed to wait 10 years instead of the usual 7 (and at that time it was 8) so the judge denied the petition due to insufficient wait time.
Still, I’m reluctant to go back to the PDs office because the people there didn’t know that about the wait time. And if they didn’t know THAT, very basic, thing, what else do they not know when it comes to helping one get an RSO get a COR?
I think I read here that some have gotten an attorney through the VA, but unless there is a direct number to call, who wants to wander thru a phone tree or a VA office announcing to one and all that you the reason you are there is because you are an RSO and you need an attorney to help you with a COR?

Expectations for Registered Sex Offenders
I’ve been trying to figure why only RSO’s and not other ex-felons are so despised by society in general. Career criminals get a pass, murderer’s get so sympathy and understanding, and it seems as if all other ex-felons can be rehabilitated, cured, or forgiven, but a RSO’s status is lower than low, bottom of the trash heap. Why is that?
Here’s what I think; society has a taught or learned expectation that a RSO will re-offend. People are waiting on the edge of their chairs for a registered sex offender to re-offend, all the while law enforcement and legislators keep telling the ever so gullible public that it’s going to happen soon, look out, lock your doors, hide your kids and pets. New laws are passed with that expectation in mind, that I’m going to re-offend and to make sure I don’t, there needs to be more laws to stop me from re-offending.
Now the reak kicker is that there are no numbers to verify what the public is being told about RSO’s, in fact, it is just the opposite! RSO’s are the most compliant, docile group of ex-felons and we have hard statistics to prove that. The lowest recidivism rate next to lifers, countless studies showing the lack of re-offending, real, scientific studies disproving what LE and legislators harp to the public about.
RSO’s have not lived up to the expectations of law enforcement or the public, nor will we ever. What is being told to society about RSO’s is a myth, a lie and just another way to keep money coming in. Someone is getting rich off of RSO’s…talk about a golden fleece!

He voted in favor of public SO registries not being “punitive” and being valid public safety measures when that case was before the SCOTUS.
I could see the same legal precedence being used to round people up and confine them.
It’s always frustrating when hacks like Scalia preach about civil liberties and the constitution but then turn around and violate this in their court rulings.

I was just looking at some California law. And I came across something about retroactivity that I hadn’t seen before — making it clear that you do not need to show punishment in order for retroactive application to be barred! I might be stretching here, but I don’t think so, so let me put this out there for thought (and I’d love to have this tested in court pronto):
I see at California Penal Code Section 3, which is about Preliminary Provisions, it says:
“No part of it is retroactive, unless expressly so declared.”

Then, looking at 290, it never actually says it is “retroactive.”

It does say it applies to “Any person who, since July 1, 1944, has been or is hereafter
convicted in any court in this state …”
But even with that line about going back to 1944, since 290 is in the Penal Code, it cannot be applied retroactively. Thus, even if your offense came after July 1, 1944, they cannot apply any new registration requirement on you retroactively — simply because the registration law is in the Penal Code! You do not have to show registration is punishment, as the California Penal Code itself says that simply the fact it is in the Penal Code means it cannot be applied retroactively.
This strikes me as huge. This would seem to bar any provisions of 290 adopted after your offense from being applied to you retroactively. I think it also would eliminate the registration requirement for all those who once were relieved of registration simply by completing probation and obtaining the relief of 1203.4 PC, which used to be the standard for both felonies and misdemeanors to be able to stop registering (that standard changed for felonies in the mid 1980s, and for misdemeanors in the mid 1990s). Because, once you no longer had to register, they can’t change the registration law so that you no longer are relieved of registration,
Of course, the problem here is that if this were challenged in court, and won — the damn Legislature would simply add language into 290 saying it is “retroactive.” Then we would be back to having to prove punishment. Or, maybe now that Calif RSOL is out there, and lobbying, maybe we could prevent the Legislature from adding that language. You see, the Legislature would have political cover in that case, because the courts had ordered that. Its a lot easier for them to NOT do something, such as add in “retroactive” language, than it is to eliminate something already on the books.

Any Good Reputation Suppression or Repair Services out there? I’ve just gotten off probation early and got the judge to simultaneously reduce and dismiss my 311.11(a) charge. Now I’m thinking of looking for a new job. I’m on Megan’s Law, unfortunately, so someone can always find me on there if they look.
But is there some service out there that anyone has used or knows of that is able to help bury Google search results so other sites that pick up Megan’s Law are suppressed until farther down in the search results?

Hey check this out. Look at how many children are killed. The re-offence rate is 30%. Wow.
They need a registry for drunk drivers.
Put “drunk driver” on their licences so everyone knows.
Some states can make them put signs on their cars.
Some cities can ban them from the roads in city limits or driving within 2000 feet of a school. How will they know until they get there? That’s their problem.
Failure to have the sign on the car: six years in prison.
Family members driving the car share the same ridicule.
It makes it more likely they will get pulled over for a minor offence. Denied jobs, tires slashed, not allow in public parking zones. Well they asked for it. Nobody made them get in the car drunk howevwr long ago.
They must submit to compliance checks at their home to see if they are hiding any cars.
They must put a sign on every car they regularly drive, even those registered to others.
They are incurable. We must act now.
The sign requirement can be expanded to include texting and speading violators. Put them all on the Drunk Driver Registry.
Is this punishment? Even though they have done their time and remain sober? Naw, it is just a requirement, like getting a regular license. Heck statistics don’t lie. These people are more dangerous than your average sex offender. Why treat them differently.
