Federal Appeals Court Overturns Conviction For CHP Cop Who Trolled Internet For Minor Girls

http://blogs.ocweekly.com/navelgazing/2014/10/chp_pervert.php

Is there a reason we never see the following headline:

Federal Appeals Court Overturns Conviction For Average Joe Who Trolled Internet For Minor Girls

Federal judge Anderson sentenced six ex Los Angeles deputies for obstruction of justice …judge said “blind obedience to a corrupt culture has serious consequences”…the judge noted deputy Tara Adams for her courage. Who testified deputies asked her to alter booking records to make it appear an incident took place. The judge stated “none of you showed that sort of courage”.

Deputy Tara Adams refused to alter records.

Had the integrity and hero Tara Adams been one of the oc court personnel huddled in the back hallway immediately after accusers answered statement that confirmed my innocence and accuser’s motive for accusation..I would NOT have or be in the status orange county put me in..Tara Adams would have refused to alter record.

I AM CURIOUS TO KNOW WHAT WILL THE NEW TIER SYSTEM DO THE RSO THAT HAS MOVED OUT OF CALIFORNIA AND DEEMED A TIER 1 RSO, HOWEVER THE STATE THAT I MOVED TO WILL NOT LET ME OFF OF THE REGISTRY UNTIL CALIFORNIA SAYS OTHERWISE. I WOULD THINK THAT THE NEW TIER SYSTEM IS DESIGNED TO HELP THOSE THAT HAVE BEEN ON THE REGISTRY FOR A LONG TIME THAT HAVE MOVED TO OTHER STATES AS WELL.WHAT WILL THE NEW TIER SYSTEM IN CALIFORNIA DO FOR REGISTRANTS THAT HAVE MOVED. IT WILL BE ALMOST LIKE DOUBLE JEOPARDY BECAUSE THE STATE THAT I LIVE IN ONLY HAVE ME ON THE LAST BECAUSE I AM REQUIRED TO REGISTER IN CALIFORNIA. PLEASE HELP, I HAVE BEEN ON THE REGISTRY SINCE 1997. IT SEEMS LIKE THERE IS NO RECOURSE AND ALL I KEEP HEARING IS THAT YOU HAVE TO BE A RESIDENT OF CALIFORNIA TO COME OFF THE REGISTRY WHEN THE SEX OFFENDER REGISTRY BOARD MOVES FORWARD WITH THE NEW
TIER SYSTEM!!!

I’ve noticed I’ll get anywhere from 1-4 likes on a given comment, then the buttons go grey…instead of red & green.

Just a few FACTS for the record:

1. Sex crime recidivism is much lower than what people think.

2. Those who offend against adults have a higher recidivism than those who offend against children.

3. Pedophiles who molest pre-pubescent children have much higher recidivism than statutory age of consent offenders who offend with teenagers.
4. Incest offenders have the lowest recidivism of all.

5. Most re-offending occurs within the first three years and drops dramatically thereafter.

6. Recidivism risks drop sharply with age.

7. Former offenders with years of offense-free living in the community pose little risk of recidivism.

8. Contemporary treatment programs have shown a demonstrable reduction in recidivism.
Even the vast majority of the highest risk “Level 3″ offenders do not re-offend.

9. The most dangerous precursor for sex crime recidivism is a sex offender with a rap sheet that includes other non-sex related crimes.

10. First time offenders who are not listed on any registry commit approximately 95% of sex crimes.

11. Most victims of child abuse know their abuser.

12. Danger from strangers is a very rare occurrence.

13. One-third of all child sexual abuse cases are committed by other children.

14. Residential proximity to places where children gather such as schools and playgrounds do not increase recidivism.

It’s time the truth is known. Don’t let politicians continue to spread lies with their hate speech attacks against a tiny minority for their own selfish political gains – call them out and let the facts speech instead!

Tired of Hiding,

Good post, thank you. Might add one more statistic…A child, especially a teen driver or a teen in an Explorer program has a greater risk of being molested by a cop than any registered citizen. The “boys in blue” sexually offend at a higher percentage than do registrants.

In April 2010 the United Kingdom Supreme Court ruled that indefinite notification requirements contained in section 82(1) of the 2003 Act were a breach of individual human rights…

Hi,I live in Sacramento,Calif ,I was convicted of 288a in 1982,did jail time ,10 months,county.

I have been a model citizen since I got out of jail,I’m extremely paranoid about any changes in the law.Recently I found out about pepper spray, unbelievable, dirty rotten politicians. My question is when you buy a car or use another car,you only need to let the police know this when you do your yearly registration, this is the way I believe it works. One time I had registered for the yearly, then bought a car,I went in to register again
a cop came out and told me ,don’t worry about it,do it on your next yearly.
Is the rule that you only have to register a change in car ownership or use of ,is at the yearly registration correct.

Thanks

All registrants should get involved in local government and get to know your political leaders for no other reason than to be heard and by doing so you put a face on those not represented. I am very involved in helping to get elected a couple of people that at least will give us a fair shake. Engage, engage, engage!

I live in nevada and if I owned a car I would register it every year.how ever I own a scooter which is not.no plates.I cant findout what laws protect us or me from those who misuse the information, which has caused me to not beable to work.does anyone have information on laws that protect me, and can I file and get social security

Jennifer Lawrence recently provided her point of view about the images that were leaked of her and others. She said who people who look at the leaked photos, and those who distribute the leaked aka “stolen content” are committing a sex crime.

Someone or a group of people did steal all the photos and videos that have been leaked so far and I agree that those people did commit the crime of theft. I do take issue with the notion that any sex crimes were/are being committed. First of all the leaked materials were created consensually by those who appear in them usually by using some type of smartphone. Secondly they were sent or uploaded to a profile that someone else has authorized access to. Third none of the material was created to damage anyone who features in it, but rather to communicate with significant others a deeper honest and open expression of oneself that should be part of any healthy relationship. Fourth the celebrities, athletes, and other known people (mainly women) who appear quite exposed and vulnerable at times in the photographs and videos leaked have the power to control how society views them. Not one person who has had something leaked, even they are fully clothed should be ashamed by what was leaked. They knowingly created the content themselves and ought to own who they are by stepping up and saying “yes I am extremely angry that someone violated my privacy by stealing what they did and releasing those items for the world to see. However I am not ashamed of who I am, what I look like, or that like every other human being have a sexual side.”

I won’t even deal with the claim that some people who had stuff leaked were under eighteen at the time of the creation of said content and as such those things are child pornography. Except to say anyone who decides to publicly declare they created something of themselves which might be questioned under the law is asking for attention and trouble they should seek to avoid.

You make a good point — and it could be a challenge to prosecution. I just looked up the statute — and it does not define “enrollment.” So, you are right, how are you to know whether you need to register every time you start a new semester or quarter, as that could be considered “enrolling” in the semester? It seems to me to be vague, and probably unconstitutionally vague — at least as applied to each semester rather than when you first start attending that school.

But of course, that kind of challenge would be very costly to bring, and certainly require going up the ladder to the appeals court, maybe the state high court. And I note, the statute specifically states that this offense can be prosecuted as only a misdemeanor — no matter your original offense that required registration, and punished by a maximum fine of $1,000, no mention of jail time being allowed.

“Screwed By My Plea”

This is an excellent video (1 hour and 20 minutes) of a very detailed discussion of the plea bargain process and how it works (and mostly doesn’t) for sex offenders. It is presented in a question and answer format – I HIGHLY recommend you watch this…especially if you (like me) were in fact SCREWED BY MY PLEA!

The video is presented by Reform Sex Offender Laws, Inc.

It’s been well over a years since Prop 35 was argued. I am extremely curious as to the delay for the decision. It was only a three-judge panel. I know one of the judges was on personal leave for a few weeks last Christmas, but other than that this should have been a relatively easy decision.

As always, I stipulate that the ordinance is not being enforced at this time, so it’s good that we don’t have that burden to bear at this time. On the other hand, I shudder to think the amount of time that has passed will produce the atmosphere for wordsmithing that must be going through the judges’ mindsets in trying to justify the ordinance in lieu of their overwhelming overt disgust of the state’s assertions during oral arguments.

Someone some months ago posted information about education/vocation funds available to RSOs, ex-cons or another group to which we belong.

Can you please share this information again? Thank you!

Another wrongful conviction ..wrongful conviction in california after the person was still in prison at the seventeen year mark..judge ordered release from prison today in the news ……Amazing ..Amazing.

I have been thinking about this whole “revenge porn” issue and hacked photos and information that is becoming common place and in the news everyday now. They are passing legislation all over the place to stop it and that got me to wonder…

Seems to me that since posting sensitive personal information, including photos, address, email are a violation then so are the registries.

This is revenge and spitefully and serves no purpose other than that. These lists posted online are of individuals who have served their time…been on probation…and paid their debt to society already. This is public shaming plain and simple. It is designed to humiliate and cause embarrassment to the individual.

It is a violation. We are being violated.

This information is being posted as a form of revenge/punishment and has not saved anyone but most certainly has been used for revenge and this personal information has been used to kill many of those on the this revenge list and countless others have been harassed and mentally abused and tortured thanks to it.

I think it is time to put an end to these “revenge lists” and stop pretending that they do not hurt and cause pain and suffering to those forced onto them with no chance to get off – ever.

Certainly this is blatant cruel and unusual punishment and that is clear to anyone who is being honest about it!

@ Eric

Regarding the woman wrongfully convicted…seems like another case of police misconduct. When will those officers who see themselves as psychologists, jury, judge and executioner ever be held accountable for their misconduct? Police ought to be held liable and subject to equal, if not more harsh, criminal and civil penalties for their intentional misconduct. The whole lot of ’em seems corrupt!

When is California going to rule on residency restrictions.and how come the restrictions doesn’t applied the whole state only to those
in la and san Diego I’ve have a friend who lives in riverside and on parole? Why is it legal for operation boo to continue? when did parole go to five years for a sex offender when judge gave him 3years when did change how legal. Sex offender has no right, no freedom ,and no justice

I notice alot of “Action Groups” online has their own recommendations on who or what to vote for.. Can we have a section for that here?

I just got turned away from registering. First it was no longer registration available on Saturday (but they still do livescan). Then no longer at 8am, only after 9 am (show up to a preexisting line…). And now you must be there before 2pm.

So how long before I fail to swim their obstacle course timely and get popped for not registering?

And just so I can vent it, every time is some smug deputy seemingly enjoying getting to turn me away.
