TRENTON, N.J. (CN) – Polygraph testing is par for the course when New Jersey releases sexual offenders on permanent supervision, but the state’s parole board is barred from using such tests as evidence, a state appeals court ruled today.

because the parole board instructs its test examiners to administer Miranda warnings at the beginning of each session.
This part really gets me. They read you your rights but force you thru coercion and duress withthe threat of imprisonment if you don’t take the test.
To put this in perspective, New Jersey imposes “parole supervision for life (PSL)” on anyone who commits certain offenses.
According to New Jersey law, if you are mandated a PSL sentence, you are subject to its restrictions for a minimum of 15 years. The following are some of the convictions that can result in your being ordered into the PSL program:
Aggravated sexual assault
Sexual assault (Rape)
Aggravated criminal sexual contact
Certain types of Kidnaping
Endangering the welfare of a minor through sexual contact or causing the child to engage in pornography (including Internet solicitation)
The following restrictions apply to all parolees while in the program:
Increased monitoring by your parole officer
Unannounced home visits
The need to obtain permission in order to travel across state lines
Wearing of an electronic monitor
Written permission to access a computer with internet access
Installation of software or hardware to monitor internet usage
Unannounced inspections of your computer system
PSL has been successfully litigated against, and ended, in Massachusetts. If NJ had a JB this law would have been seriously challenged already.
Is it different in California? I’ve taken 2 polygraphs. The last one I specifically remember in the paperwork I had to sign it said that by doing so I was waving my 5th Amendment rights. I was required to sign this before taking the test. I don’t remember what the paperwork said for the first test I took.
Tests are definitely BS though, and a huge scam.
