While his bills aimed at addressing California’s housing crisis are expected to be some of the most closely watched legislative fights this year, gay state Senator Scott Wiener (D-San Francisco) will also be pushing to pass legislation focused on LGBT issues.

Another bill Wiener plans to introduce this year would prevent gay male adolescents from having to be listed on the state’s sex offender registry. He aims to include a “Romeo/Juliet” clause for gay teenagers so they are treated similarly to their heterosexual counterparts.
Under the current law, if an 18-year-old boy has sex with a 17-year-old girl he can be prosecuted for statutory rape. But if he is convicted, the boy does not need to register as a sex offender, noted Wiener.
“If you are an 18-year-old boy having sex with a 17-year-old boy it is statutory rape and you have to become a registered sex offender,” said Wiener, “because it is anal sex not vaginal sex. So we are going to introduce a bill to eliminate that inequity.”
Why stop at Romeo-Juliet type cases?
If any male where to have statutory sex with a minor female, they will get convicted, but not be put on the registry. Age doesn’t matter here.
Hofsheier tried to identify this, but years later the courts reversed course.
Statutory intercourse sex = no registry
Statutory oral sex = registry
Statutory anal sex = registry
The only difference between the three is the prefix, but one of them is being lauded differently from the others.
@ New Person: You should put this out to Senator Wiener. Please contact his office, write a letter, send an email, etc. It is important that our legislators hear from us. He may not be aware of Hofsheier and these important points you bring up.
I will read the Bill that he is proposing and if it does not include the points that you bring up, I will certainly be contacting his office to see if the Bill can be amended appropriately.

WEll, AERO1 ( I am a rw priv pilot), it has to do with the LGBT folks ON HERE, me as one, that were punished and put on this registry for being GAY and chased and set up by PD or SO.
SO, to answer your question, Senator Wiener has fought for all us taking over for Senator Lara for pushing the ONLY Tiered Reg bill since city of SF and Safety Committee retiree Tom Ammiano (yes, all LGBT including another ret. Mark Leno).
At least SOMEONE attempted to make a Tiered Registry for California and for you (ACSOL/all4consolaws).
NO REAL change for RC’s until this was put through (and shot holes in and removed better treatment for some away from the original Wiener had submitted). Even though this doesn’t help alot, it’s a start, I think that’s what Janice B. has stated over and over. Please try to understand, IF you are a fam mbr or RC in CA.
