Now that’s loophole switch. A sex offender called for jury duty and in America. Someone needs to inform jurisprudence or the judas reform board, oh wait a minute he hung himself. Who ever heard of a tag or hash tag of lol… laugh out loud. One wonders what adult started. Use that in a sentence of God save the queen and everybody would be in prison as that doesn’t show respect for anything or are you Aretha Franklin or even James Brown.

One wonders do we all look down even on the drug addict, the protestor, the Christian, the murder, or the one making the carnival ride easier or the court systems trying to play or Government trying to play God above. Theirs only one in authority. Talk about love thy neighbor but don’t walk on the grass or keep away from my barrier relief plan. Sure when authorities get a foot hold on one’s life they will try and trample it down anyway possible.

So who serves two masters today is is a lot of mentality and character like many on here and I’m sure most on here are not happy campers if the truth be known. Is the black person a happy camper today when we all wittnessed what expired on TV or does the government say we can fix it all by sending they all a check like this contrivris stripend or whatever and I never even got one but thats not the point. The point is true justice plain and simple. Now some water down plea deal. Can a plea deal bring a life back or can true wisdom and understanding grace and truth be the great cure all, or where is mustard seed faith.

So either one takes a stand or one falls just like the black lives matter is taking a stand. Back when all this virus thing started everyone was saying now their getting a dose of what we go thru daily. That was sort of vain and out of line. Even I could be out of line on everything course I’m not going to hide my head in the sand as we all have view’s on this registry.

  2. A.D.A.T.

Currently prepping an expungement letter to court. I am filing on my own. Would be interested in anyone’s advice that has written one as to content.

    Thx.

  3. someone who cares

A.D.A.T. – If your offense is eligible for expungement and you completed your term of probation, it HAS to be granted, so I am not sure if anything else is necessary to try and convince the judge. At least that is how it is in California. Maybe some others can chime in to either agree or disagree, but I am pretty certain it is the law to grant expungement after probation has been successfully fulfilled. Now, a reduction to a misdemeanor, if a felony, is at the discretion of the judge. I am not a lawyer, but I hope others will add their knowledge and opinion.

    • A.D.A.T.

On the C180 form it mentions any supporting paperwork. I took that to mean adjudications, probation summaries, as well as reference letters and pleas to judge . I could be mistaken. A 17b is part of this form so maybe those references apply only to that section. I will consult with a lawyer.

  4. Saddles

A.D.A.T. actually I like your views and yes while we may or may not get to meet people that are involved in the registry we all have to hold ourself up. Maybe instead of sending my soap bars to Will Allen I should of sent them to “All the Presidents Men”. I guess it was fun to watch “Smile your on candid Camera” way back when. Today it has a different prospective.

Expungement letters are they like mercy and truth letters or get out of jail passes. Even in my own ordeal I had a bit graphic text. After going thru sex offender classes they felt that I needed to retake the class again but something happened that changed. They call me in and say we feel, the D.A. the PO, and my class instructure felt because of your Christian views they no longer welcomed me into the class. So where is this bible used today in government or is the bible of divine justice. Guess today everything its written in some planet hollywood script if a macabe nature. or is that how people choose today.

One wanders who tried to grasp the brass ring instead of the golden ring today. Do many governors forget to wear a mask as in Virginia or any other State. Are the say as I say or else you will have to have a time out before play time. Who disclipines government people today or even corrects today. Yes Janice and her team are good counssel in many area’s and yes I have to say we all need to take a stand and yes orginazation is very good or should we all say do unto others as you would have them do unto you. Talk about a quid pro quo method.

A.D.A.T on your writing just be direct and to the point, make your letter meaningful as you can. I’m sure others on here have wrote letters like that also. Stepping up is the right thing to do in so many ways.

  5. WOW

So, there was a little change in the law recently and a lot of these vigilantes are too stupid to get it.

287 (a) Oral copulation is the act of copulating the mouth of one person with the sexual organ or anus of another person.

    (b) (1) Except as provided in Section 288, any person who participates in an act of oral copulation with another person who is under 18 years of age shall be punished by imprisonment in the state prison, or in a county jail for a period of not more than one year.

    ***

288 (a) Except as provided in subdivision (i), a person who willfully and lewdly commits any lewd or lascivious act, including any of the acts constituting other crimes provided for in Part 1, upon or with the body, or any part or member thereof, of a child who is under the age of 14 years, with the intent of arousing, appealing to, or gratifying the lust, passions, or sexual desires of that person or the child, is guilty of a felony and shall be punished by imprisonment in the state prison for three, six, or eight years.

    (b) (1) A person who commits an act described in subdivision (a) by use of force, violence, duress, menace, or fear of immediate and unlawful bodily injury on the victim or another person, is guilty of a felony and shall be punished by imprisonment in the state prison for 5, 8, or 10 years.
    ***
288a (b)(1) used to be what is now 287(a)(b)(1)

What a difference that little “a” makes. I hope the DOJ understands the change on the 1st of January.

  6. Peter

I am off probation in November I have a misdemeanor and they gave me 10 years on the registry. I am going to file for expungement and I am also going to file a motion to get me off the registry. I would have done 3 of the 10 years on the registry. Has anyone had any luck doing this? Is there any advise anyone could give me? I was caught in a sting on the adult website backpage they dropped the age to a 17 year old when I got to the location. I didnt even do a prelim we just went to court for 7 months and did nothing. On the day of my prelim the DA offered me a deal and my attorney told me to take it because I was going to loose no matter what. They didn’t have me take classes I have no restrictions my fine was $150. I just want my life back I lost my house job ect. I am lucky my parents let me stay at there house or I would be homeless. Please any advise would be welcomed thank you guys so much.

  7. Impatient

    Am I being selfish?

Filed a COR in July of 2019 in Los Angeles Superior Court. I was told the process is a six-month journey and given a January court date. Arrive for court in January and DA continues matter to conduct investigations. Given another court date for mid-March. Covid hits followed with protests and it’s been continuance after continuance since. Now I have an August court date with no guarantees it will be continued again. Fiancee was offered a promotion along with a generous relocation package to another county. She’s scheduled to start in August. Now we are contemplating living separately because I need to have my COR hearing before I can leave LA county. I know there’s a virus floating around Los Angeles and I’m trying to be patient.

Are these things generally easy to get, the COR? Perhaps I’m making this into something bigger than what it is. I’m talking about a misdemeanor sex offense with a favorable report from forensic psychologist giving me the green light for relief.

Courts won’t do telephonic or remote appearances for CORs. In the meantime, I wait. Patience is not my strong suit.

    • Mot

I got my COR in December in LA county court. I worked with Public Defenders Office as they have a department for COR. The first date had the ‘wrong’ judge on the bench so came back again and before that the DA decided that I needed a report from a psychologist that I had been in counselling and was “highly unlikely to re offend” Oh, my charge was 664-288(a) unfortunately I will have to register until July of next year when the Tiered goes into affect. So be careful that you might still have to register when you relocate to another county even with a COR

      • Impatient

I shouldn’t have to register anywhere in the state if the COR is granted.

I may have to register initially upon my arrival in new county as DOJ paperwork gets cleared, but as soon as my attorney gets the cleared paperwork I’ll never have to register again for the state.

        • SR

You’re correct in that if you have a COR that removed you from the registry that it applies for every jurisdiction within the state. However, simply having the COR does not end your duty to register. COR in itself doesn’t have much to do with the registry. It simply gives you a stamp of approval for obtaining licenses and other things that your conviction (sex offense or something else) disqualified you for. For a COR to end your registration duty, you have to have a qualifying offense as listed in the current 290.5. It’s this same code that will be changed to the tiered registry next year, removing COR as a potential path off the registry, but still leaving the COR itself intact for the purposes of needing for the previously mentioned items.

        • New Person

          @ impatient,

The CoR can relieve you from the registry unless you fall into specified sex offenses. Here’s an excerpt from a pdf form online:

          ***
You are ineligible for a Certificate of Rehabilitation if any of
          the following are true:
          • You were convicted only of misdemeanors (other than
sex offenses defined in PC § 290, which were
          subsequently expunged); and/or
          • Were convicted of any of PC §§ 286(c), 288, 288a(c),
          288.5, or 289 (j); and/or
          • Are serving mandatory life parole; and/or
          • Were sent to state prison under a death sentence,
          and/or
          • Are currently in military service.
          ***
          link: https://saclaw.org/wp-content/uploads/sbs-certificate-of-rehabilitation.pdf

Mot earned his CoR, but was not allowed to de-register because he had a 288 conviction.

Impatient, you need to talk to your lawyer to see if your conviction qualifies for registration relief.

  8. Saddles

Seems like everyone wants tips and how to go about these expungement letters. I know many want to get free and clear of these ordeals and be free of much of this. While myself I’m just going thru the motions of all this and if I have to wait to complete my whole probation than it is what it is. Yes I sent in my paperwork for a pardon and it was accepted. They also wrote me a letter and said it would take up to 2 yrs or longer for an investigation. Guess a potty mouth is wrong when they wanted me to talk dirty to them. One guy talks about copulation on here , well I suck a milk shake out of a straw. So lets not pussyfoot about this as we all want this registry over.

Oh yes I have had I my number of e-mail scam type people, or ladies wanting to hook up or giving suggestive or subjectives come on’s but I never replied to them. I have even had scam people wanting some plastic bit con chip money with a blackmail con attached. Seems people want to suck people dry or test others again and again. Its all a cunning and crafty trickery at its best.

As far as a letter of redress of grivance or an expungement letters they need to be truthful and show a positive meaning when asking. Sure you can use a bit of remorse, good news gospel, but remember much of ths registry is a perverted ordeal. Its more of a hearing process in these types of trickery. Such as if they ask you to bring rubbers or condoms, show more pictures, watching their text or if you get a chance to talk to them by phone listen to the voice pattern if the voice doesn’t sound right its all for show to induce one in this ordeal. Hearing is a key factor. So when one talks about injustice here’s some view’s from the bible.

You shall not do injustice in judgement. You shall not be partial to the poor. In righteousness you shall judge your neighbor Lev. 19:15. So is it righteous to set someone up. Another scripture says Deut 16:19 You shall not pervert Justice it tells about taking bribs, and twisting righteousness or Hab. 1:4. Therefore the law is powerless, and justice never goes forth. For the wicked surround the righteous: therefore perverse judgement proceeds.

Even Matt. 23:23 says “Woe to you scribes and Pharisees, hypocrites! For you pay tithes of mint, anises, and cummin and have neglected the weighter matters of the law. Justice, Mercy, and Faith. These you ought to have done, without leaving the others undone. Hope this helps in these registry issues and gives guidelines to some on how to address this issue with these sting internet inducements that are vain and blind justice in many view’s.

  9. The Unforgiven

I have a 664/288(a). Probation granted 6/2008 and expired 6/2011. While I thought that I was past the 10 year mark to apply for a Cert of Rehab, I actually just had my 9th anniversary. I understand that this is last minute but if possible, I would like to still see if I can clean up my record prior to the new laws taking effect. Has anyone applied before the 10 year mark? Would it even be possible? Thanks in advance for any info.

    • Interested Party

      @The Unforgiven

I am a little confused with the information you provided. In terms of the CoR your 10 year clock starts once you are released from custody, or if you served no time it starts at your sentencing.

Probation time counts for your 10 years. It’s 10 years in the community even being on probation counts. The

      • The Unforgiven

        @Interested Party

Sorry for the confusion. Probation started 6/2008 and ended 6/2011. It seems you did get what I was trying to say and I thank you for the information. I was trying to find out when the clock started and by doing so, I would know if I have gone over the 10 yr period.

    • New Person

      @The Unforgiven,

      Probation: 6/2008
      End of Probation: 6/2011

Question… Did you earn your 1203.4? That could help with your CoR as it’s a legal, accepted step toward rehabilitation.

Also, IIRC, your CoR time starts upon your date of conviction/start of probation. That means your CoR timeline is 6/2018, not 6/2021. At least, that’s what my lawyer had told me. But I would contact a lawyer to confirm this. The sooner, the better.

Good luck and I hope you can get your CoR.

      • The Unforgiven

        @New Person

Thank you for your input. I wasn’t very clear that what I was looking for was when the clock started to then figure out when the 10 yr mark was achieved. I have not earned a 1203.4. I have stupidly waited until the last minute and thought I was only at my 9th year. Having this new information, I will indeed pursue the matter asap. Thank you again.

  10. AERO1

Had to do my annual registration today with the long beach police department it was quick fast i was in and out within 5minutes.
When the cop came out to give me my copys he ask me if I heard about the new sexofender tier law SB384 that goes into effect next year
I was curious to hear what information he had on the whole situation so I said no I haven’t and he told me I was looking at ur case information and it looks like you qualified to end your registration next year and that I would be receiving a letter in the mail within 2 months…

Allegations against porn star Ron Jeremy by 4 women for sexual assaults. Jackie Lacey must be desperate for reelection…

    https://deadline.com/2020/06/adult-film-star-ron-jeremy-charged-with-three-counts-of-rape-1202967642/

For some reason this article makes me sad. 🙁

  12. New Person

Looking up the CoR to answer a question to someone on the General comments section, I saw the following in a box stating:

    ***
    Are you eligible for expungement?

Most misdemeanors and “wobblers” (felonies that could have been charged as misdemeanors) may be
expunged. Expungement is easier and has more benefits than a Certificate of Rehabilitation. A recent change in the law, Prop. 47, added a number of non-violent felonies to this list. See our guide on Expunging Criminal Records if you think this may apply to you.
    ***
    link: https://saclaw.org/wp-content/uploads/sbs-certificate-of-rehabilitation.pdf

How is it that other convicts are helped out by expungement except for registrants? If you earned an expungement, then you don’t need to apply for a CoR. There are more benefits to an expungment over a CoR, but registrants cannot enjoy all those benefit such as regaining privacy with the accusation/information dismissed. Or the increased opportunities for landing jobs by making it a illegal for companies to use outside parties to look up information on you… except if you’re on the registry.

Again, registrants are systemically segregated and discriminated through the courts, all of which are under penalty of law that leads to punishment.

Why must registrants jump even far higher than all other convicts when our recidivism rates are quite low and has been for years, according to CASOMB. The last report from them that I read was from an ACSOL article citing less than 1% recidivism rates.

  13. Saddles

Actually I’m getting an education from you all on here. I was watching an old movie on here last night called ” The Bird man from Alcatraz” and yes he spent nearly his whole life in prison but many say he was a self made man with understaneding. While he knew about bird diseases and a lot about human understanding, even wrote a book on prison systems, plus help medical understanding advance abd I’m sure he could quote the penal code by heart and tell you every code in the book. I wonder if he was a genius that spent his practically his whole life behind bars.

Yes he helped society in many ways from prison. Course I don’t think any of us killed anyone on here but many are killing themself on here. Seems like all on here think too much or maybe have to much pride in their character make up. And I thought we were all borned naked. One wonders if the law or government is naked today in these encounters in many ways. Inducing one like this in this type of prostitution way. Isnt that what the birdman went to jail for killing a man over prostitution. He could of been hung also and yes put to death.

One wonders who is killing themself over this vigilantie Justice of their own person in this internet type encounter of man out witting mankind with some prostution encounter. Sure a good review of the movie might be worth watching again and yes many should put all this in prospective in this new age of internet prostution by police means. Is that what a servant Minister of God is all about in all this internet upheaval.

  14. AERO1

The CoR is pointless don’t get me wrong it would be nice to have but it won’t relieve you of your duty to register. In my opinion its just a waste of time and money.

The only way a sexofender can be relieved of there duty to register in the state of California is thrue a governor’s pardon and never in history has a califorina governor pardoned a sexofender and never will

    • Interested Party

@aero1 … I was relieved of being forced to register thanks to my CoR procedure … there are no guarantees. A number of other former former registered citizens have also been relieved.

The day I went into court 3 citizens forced to register were granted a CoR and per the judges orders relieved of having to continue to register.

Depending on the jurisdiction you live in, it can be worth the time, effort and/or money.

      • Mot

Just some FYI if you live in LA County contact the Public Defenders Office they have a group who will get you the COR at no legal costs to you Been there did it

        • The Unforgiven

          @Mot

Does the 1203.4 and the CoR need to be addressed in a certain order or can they be dealt with simultaneously? I am in San Bernardino County and was told by Miriam with LA County that expungement with county that case occurred and CoR with county of current residence.

        • Interested Party

          @unforgiven

I believe you need to get the 1203.4 as part of your submission for the CoR (at least for a conviction which forces you to register under 290).

  15. someone who cares

AERO1 ~ A COR in California will relieve some of the duty to register. Those who are not eligible to obtain a COR (there are exceptions) can apply for a Governor’s Pardon, which you are correct, it has never been granted in CA.

  16. C

    Check your Facebook accounts.
Some a-hole going by the name Caitlin Renee Cross replied to a few of my FB posts with my 290 registration page and photo.
I THOUGHT I had my privacy settings dialed in to prevent this kind of BS, but I guess not.
I deleted my FB account. It was a massive time waster anyway and hopefully there won’t be any fall out.

  17. James (monthly donor)

Has anyone here had a stranger call you on your phone where they ask you if you’re so-and-so and to confirm your address as indicated on the Megan’s Law website? The stranger sounded like a cop but the reception was really bad where he was breaking up every other word he was saying. So I asked him where are you calling from to which he responded, “Los Angeles, California.” I was expecting him to say from a law enforcement agency because I think I read from here that there are extortion scams targeting registered citizens where the caller identified himself as a cop. This one didn’t. He said that he tried contacting me three days ago (I never got such a call) and that I needed to hear him out about “sex offenders.” What’s troubling is how did this person get my phone number and identify my name and address?

    • James I

      Dear James (The Good Donor)

Yes, I received one last week. However I noted that I was almost sure it was from an 866 number and I tried to call it back after I pretty quickly hung up, but calling back was to no effect…number was restricted.

Your post caused me to look up the 866 Area Code to see where the call came from…and it came from nowhere, nowhere specific at all.

      See here:

“A prefix of 866 represents calls that are paid for by the recipient, rather than the caller. When people think of toll free calling, they usually think of 800 numbers, but there are many other options that function in the same way.”

What the Hell? I Will be careful not to answer any 866 calls in the future…you can also have 866 blocked, which I may do.

I am not at all certain that your call and my call were at all the same (but they do seem perfectly similar)…this seems to be a different kind of scam (I think)…this is just FYI as to my experience.

Good Luck and Best Wishes, James I

      • area 51

the number very likely was a caller ID spoof ( not the real number of the person calling ).

    • C

Unfortunately, your phone number is easy to find using free online tools. It’s the age we live in. Not only did I get one of those calls, my elderly father did, as well. He called me in a panic that the cops were looking for me.
I recommend checking all the information brokers (white pages, spokeo, etc.) that have your info – most have an opt-out method.

An online petition calling for her resignation alleged Krewson “directly endangered the lives of protesters by releasing their names and addresses.” It garnered more than 32,000 signatures by Sunday.

Huh. So now it’s a bad and endangering thing? I thought “already mostly public” info was no big deal!

  19. A.D.A.T.

Had something interesting happen when I reported my address change. I guess due to covid ( and evidently a troubled and biased San Jose P.D.) I was sent a voicemail and text from a detective in the 290 unit. He told me that he had noted my call to report, and since my annual was within 45 days, I could do the formal address update at that time. Obviously I kept both voicemail and text.
This actually allows me to get settled with any curiosity prone neighbors for at least 1 month before my horrid details are splashed across the local Megan’s page. It could also delay or even confuse the housing sites that post that stuff.
I hope that meeting me and seeing that I am in fact a decent person will negate the bad publicity I will soon be getting if found later. 🙏🏼

    California Tier Assignment guidelines

My address which has never been on Megan’s list is now on Megan’s List I have been 18 years at the same address and until now my address was not mapable, now it is.
I’ve contacted the Sheriffs Department It was nothing done by them, DOJ phone number immediately disconnects, I have sent a letter from Megan’s List Contact form.

Can someone help me please. By the guidelines below notifications would take place 1/1/21 of intended actions with a year in which to attempt legal action before changes go on Megan’s List. How can I effect a temporary restraining order simply to provide me that year to respond.

Beginning on January 1, 2021, the CA DOJ will designate tiers for registrants.

Beginning on July 1, 2021, registrants who meet the mandated minimum requirements may petition for termination of their sex offender registration requirement in the superior court or juvenile court in the county in which they reside.

Beginning on January 1, 2022, registrants will be displayed on the Megan’s Law website pursuant to Penal Code section 290.46 as amended under SB 384.

    • Lake County

I’m sorry this has happened to you. It sounds like your conviction date was around the same time as me. The first 10 years I was not on the public list. Although I had to worry about the Blue Line Gang coming over for compliance checks, life was pretty good with no one knowing my status. My conviction was not on any website and not one of my friends in my new location knew of my conviction including my boss and my girlfriend of 4 years. Then suddenly in 2011 I was added to the public list. I only found out I was on the list because a work customer seen me on it and told my friends about it. Within 2 months I lost my job, I lost almost all of my friends and several local businesses either banned me or were now very rude to me. It completely destroyed my normal life within my small community.

I’m not sure what you can do to ever be completely anonymous from the internet now as all the private websites (Homefacts, Mugshots, ect.) that publish your info will not just go away and stop publishing your info if you were able to get removed from the list now. The private websites that publish everyone’s arrest records and sex offender info scan for this data at least monthly and will not remove it without a legal fight.

I would strongly encourage you to review your activity on social media especially Facebook. If you’re on Facebook (and other sites) you are banned from having an account by their Terms of Service. If Facebook realizes you have an account, they will remove it. I recommend that you make backup social media accounts under nicknames or completely fake names to make it hard to get your accounts deleted. Never post pictures of yourself or use your full name on any social media account as all the big companies can use facial recognition to verify if that the account belongs to you. Also, don’t use GPS location services on your home computer, cell phone or post your real address on social media as that will only out your address as belonging to a registered offender. As Facebook buys out more companies (along with your data), you can expect their Terms of Service to mirror Facebook’s policies. Also limit those people that are Facebook friends as any of these people may someday decide to turn you into Facebook or post your registry info directly to your Facebook page. Remember that everything you do on social media is saved forever on these companies data servers even if you delete it from public view.

I hope this doesn’t hurt your life as much as it did mine.

  21. Saddles

We have all heard of this two wrongs don’t make a right on here in an article that was presented on here case. This George Floyd case is alarming as taking someones life isn’t the way to work things out. Would one call it a different situation as compaired to internet type come-on’s of someone saying: we are only meeting in the park what could happen.

One would have to say that is vain for anyone that calls themself Christian in this non-contact format. Yes several organizations such as change.org, ACSOL, ACLU, WAR, and many more are advocating for the banishment of the registry and government seems to be seeing the writings on the wall in many respects. Talk about misguided justice or Statues of Liminations.
California has a mixed culture of folks but true justice is for all in all states.
