Has anyone seen this https://www.mychamplainvalley.com/news/local-news/florida-announces-restrictions-on-vermont-licenses/ the guy on registry matters talks about how Sorna and a state license are both regulatory civil schemes. Here however one state is punishing people a certain state. Seem if there is a lawsuit it might mirror our suit in that a state should respect another state decision.
I’m off the Ca Megan’s website. Do non registered offenders have to still give 21 day notice to travel? Is passport identifier still on passports? If not required how does customs treat you when you come back to the states? We are thinking off going on a family vacation.
QUESTION: I am off the Registry and want to apply for an UNMARKED Passport ..actually have not had one for 24 years, Do I need to include a copy of my letter from CA DOJ or just submit the application? Anyone experienced this and how did it go

“New Law Alert! SB 731 Makes More Criminal Records Eligible for Sealing” . . . “Importantly, SB 731 does not automatically seal eligible records—individuals MUST still petition the court for records to be sealed.” Does anyone have additional information regarding SB731? Do we get automatic Records Sealed or do we STILL have to petition? This new law is confusing to me . Thank you for any help. I get different lawyers, online here, interpretations on this law. (I am still waiting for my personal lawyer to return my call 🙂 )
Lately I have been frustrated with my situation took a plea 2021 and got charged with 647.6 misdemeanor that I’m going to get expunged soon. Had a year of summary probation which I finished and took a year class and got the certificate before I even got sentenced and still have be on the registry for 7 more years is ridiculous.
The Electronic Frontier Foundation ( Eff.org) celebrates their 33rd Anniversary this week. The EFF are purveyors of the ubiquitous databases’ use. As such they’re bedfellows of ACLU. Collateral in mission to ACSOL & NARSOL, the EFF advocacy confronts the people’s use of the database driven (electronic) frontier. Each too confront the relative relationship between man and machine as it relates to what we call liberty.
Where these three groups diverge from one another is the first two are at their foundation, their primary perspective are focussed on the people’s perception of the violent man, while the third confronts the perception of the foundational element itself… The electronic database.
IMO not one defense strategy in FTR context is complete without including germane EFF testimony. I suspect Ms.Carpenter would say the same for defense of unlawful online pornography cases.

I just had my worst and most stressing annual registration in years. I have been registering at the same place for years. Today was my third registering officer at this same law enforcement place. I noticed a trend. The first registration for all three of these officers were horrible and stressing and each time the officer was a complete butt head. Things usually seemed better after the first registration with each one of these officers. State classified me as low risk and I am not on parole or probation.
Are you all experiencing the same?
Who monitors the DOJ to make sure they are abiding by the law? When SB384 first came into effect, I took it upon myself to look through Megan’s Law to see if he was now public. In the beginning stages, it was easy to see who was added as they had no picture posted yet. I scrolled through a dozen cities, and I came across a person from Fullerton with a PC314 offense and a Static 99R score of 5. Per the new law, an otherwise Tier 1 or Tier 2 whose score is 6+ will now be Tier 3. This person would be a Tier 1 based on the offense, and his score is only 5, so he should not be on Tier 3. The DOJ made a horrible mistake. They make mistakes ALL THE TIME. Who holds them accountable? That person probably does not even know he is on Megan’s Law. I was tempted to send him a letter.
I don’t understand how a misdemeanor and felony are viewed as the same especially when some people are able to get expungement. There needs to be some adjustment made to the tier registry on that end because how is the misdemeanor a lesser charge but you can still be placed in tier one with someone that has a felony. Shouldn’t there be 4 tiers at this point with the new tier 1 being misdemeanor sex offenses and tier 2 being non-violent felony sex offenses tier 3 mid sex offenses and tier 4 being the high level sex offenses. What do some of you think about this?
A 1203.4 dismissal is only good if your trying get a really good job with the county or some type of government agencies, other then that it’s useless But the court does Acknowledge the 17(b) it changed one of my felony FTR charges to a misdemeanor.
Every person forced to register in California should try for a 17(b) even if you don’t qualify for one, for example my 290 offense was A felony so my FTR charge was a felony not a “WOBBLER” a straight Felony, Second I also violated my probation, so probation wasn’t successfully completed and I was still able to get the 17(b)

Good Morning Everyone- Today my petition was granted out of Pomona court, Tier 1. They spent time reviewing my file and the DA came back with no objection to terminate registration. I’ll wait for my paperwork then send over an email to the DOJ. I want to thank Janice and her team as this website has pushed me through some tough times. It gave me hope that people are fighting for us all. Thank you to the people who share as your struggle put into perspective that I’m not alone. To the people reading this, never give up and keep your spirit. Never let people’s judgement get in your way of life and continue to live your life.
I live in a small town, and a small community within it, which is somewhat close-knit. California. 17 years ago, I lived in another city and was convicted of pc290ab1.
I spent several months in country jail, was released on probation, completed a counseling program, was released from probation and counseling early, had my conviction reduced (17b) and last year was finally relieved of my duty to register. My registration was never public online, but I was still required to register.
Yesterday, a resident of the community posted to Facebook news articles from my arrest and conviction, along with comments from someone who knew me back then. I do not know who that person is, feeding him the information. Anyway, this resident made a series of posts in a smaller-sub group that he moderates about me. It is only a matter of time now before the information spreads across the community.
Even worse, the person doing this is a pastor, who leads not just one church, but several! A person who is supposed to help and respond with grace and compassion, especially to those who sin, is doing tremendous harm. Unfortunately, there is no hierarchy within that organization to whom I may appeal. He is the founder and leader himself. It is a shame to see a vibrant church community is lead by someone whose first action towards a stranger he has never encountered in person, is to humiliate them.
I am terrified. I am worried not only of losing the friends and connections I have made, but that someone may choose to act out against me or my family. In my mind, I envision vandalism, even violence are possible from this person, or anyone who is inspired by him to act out.
I don’t know what my rights are. I am absolutely terrified. I don’t want to leave my house, to leave my son home alone, or even our pets. Will I wake up one night to find graffiti, or broken windows, or someone in my home?
I feel terribly violated.
This person has committed no crime sharing news articles, but he has shared comments from a an “anonymous source,” which do in fact make some claims that are false. Although how these could be proved one way or another is beyond me.
I don’t know what to do. I am a much different person now, but I am being attacked for something I’ve paid and repented for long, long ago, and by a pastor no less.

What is the point of a 360 day sentence if the individual has 350 of those days “suspended”? Is “suspended” similar to being on probation or parole for those other 350 days?? 🤷🏻♂️. If the person only serves 10 actual days in jail, why isn’t the sentence simply “10 days in jail”, since he isn’t serving the other 350 days?

Just got a scam call, on Saturday, from “Sacramento Sheriffs Dept.” telling me I am out of 290 compliance..(most definitely am not)..He identified himself as working for the Sacto Courts..instead of playing with him or an A.I. program I told him or the A.I. to F.O…phone number is 916-354-5902..
Another murder in jail: “McLeroy had a serious mental illness that had him bouncing in and out of his family’s home. According to the police report of his arrest in February 2022, the 20-year-old was masturbating on a park bench on the BeltLine a couple of blocks from his father’s house in Adair Park, across the street from the Lee + White complex. A parent with children walked by, took a picture, and called the police. A week later, the cops arrested McLeroy on charges of indecent exposure and child molestation.” “Eight months later, police arrested Jeremiah Collier on a murder charge. He was then placed in a cell with McLeroy. According to the October 2022 incident report, early on a Wednesday morning just 12 days later, jailers entered cell 515 and found McLeroy’s body tied down, with strips of bedding binding his ankles and neck to the bed frame. Collier was charged with his murder.”

Who put the MS in MSNBC?
I watched a report on the network bemoaning “IRAN’s morality police” and then I look at America which does the same. It really highlights the social divergence theory which explains the more extreme differential groups get, the more the two tend to behave alike.
So outfits like MSNBC can faint disgust about Iran’s cultural norms meant specifically to protect their women folk from the sexually aggressive male in their society, but its far more effective than any database American capitalists can dream up. However with efforts to shame Muslim culture to bring them in line with the Western radical feminist MSNBC embraces and prescribes social construction efforts and not engaging in news reporting. Sure Muslim culture demands the wearing Burke, not going solo in public, not to be alone with non family males, etc
but these limits are regulatory and with sound reason. Why the American feminist would complain is beyond me. MSNBC journalists are interested in preventing sexual attacks yet fail to acknowledge how the internet and investment in electronic culture has made things worse, less interpersonal and more expensive culturally. Less peace and not more is however rendered. Less human cops but more technology.
I see certain California Guilds are striking. Could an issue be the use of CGI? Turns out movie production by computer generated images are displacing human input( jobs)?

Movies and modern sex offenders have something in common: Made by machine’s definition.
If PC290.46 governs who is displayed on Megan’s Law, how come they don’t utilize the other part of SARATSO, which is the Dynamic Risk. Per the law: “(2) The law enforcement entity may make available by way of an internet website the information described in subdivision (c) if it determines that the public disclosure of the information about a specific offender by way of the entity’s internet website is necessary to ensure the public safety based upon information available to the entity concerning the current risk posed by a specific offender, including the offender’s risk of sexual or violent reoffense, as indicated by the person’s SARATSO static, dynamic, and violence risk levels, as described in Section 290.04, if available.” SB 384B keeps referring to SARATSO, but they only mention the Static 99R, which is only one aspect of SARATSO. They need to consider the Dynamic Factors, especially if a person has been offense free for a decade and got their offense expunged. Yet, they still only use the STATIC 99 to place someone in Tier 3 who was never before publicly listed and whose offense would otherwise be a Tier 1. So, obviously, public safety is not a concern here.
I want all registrants, family members, staff and supporters to this website to know that on this date (07/17/2023) I received a letter from the California Department of Justice, Justice Data & Investigative Services Bureau that stated I am no longer required to registers as a sex offender in this state. I did not solicit or make any request to have this action taken. For the most part, I relied on the updates and information provided through this website for guidance. You guys have been a lifeline of support and hope for thousands of Americans. I did not expect to see this happen for me but you gave me comfort that one day we would have our day of justice. Thank you Janice, and many thanks for all that stood shoulder to shoulder with us. From this day forward, I have no fear, just faith.
Does anyone that’s in the sorry state of Texas knows what Texas Voices do? I’ve sent chair Mary Sue Molnar a email asking what does she need to try get things moving? There are over 100K people on the Texas registry (RIDICULOUS) Once you hit 30 years you should have the opportunity to petition to be removed as a first time offender and no other violent felonies. When I got on to her Texas Voices site there’s hasn’t been any updates in years. it’s like they are stuck and do not know what to do. challenges and law suits is what will. Texas voices need to now challenge the legality and the unconstitutional of the LIFETIME registration. I think that argument can has standing. I don’t know is Texas Voices has an attorney that works for them? Where are the donations going? SMH

“Law Abiding Citizens”?

In the time I’ve been active in the struggle against America’s registries, there has been a lot of discussion about the harm done by being stigmatized as “Sex Offenders” and what we who are on the registry should call ourselves. Registered Citizens? People Forced to Register? Allow me to suggest: “Law Abiding Citizens.”
Why? Because the term Law Abiding Citizens most accurately describes who we really are, and because describing ourselves (accurately) this way turns on its head everything most Americans mistakenly believe about us. Furthermore, the average American has no idea what a “Registered Citizen” or “Person Forced to Register” even means, but they do know what a Law Abiding Citizen is.
To justify this description of ourselves we need only turn to what I like to call The 95 Percents. …[Over] 95% of all persons convicted of sexually based offenses are first time offenders. Therefore they are not on any state registry. It has always been my contention that any law enforcement officer who turns to the registry to investigate a sexually based offense should be fired for incompetence.
We also know that about 95% of all persons on registries never re-offend, one of the lowest re-offense rates of any type crime category. And we know that of the small number of re-offenders, the great majority do so within the first few years after leaving prison, usually while still on probation. In fact, we know that anyone who’s been on the registry for ten or more years has no greater chance of re-offending than any other citizen.
In most states …[people] are not placed on the registry until they are released from prison. Most federal and state cases also include probation, you can’t get off probation until you have “completed therapy,” and no therapist is going to certify that you have completed therapy unless they can also certify you as “low risk to re-offend.” That was certainly my experience.
So if we remove from consideration any …[person] still in prison plus anyone still on probation who has not completed therapy and therefore not certified as low risk, who are we left with on America’s registries? Answer: a population who has completed probation and therapy, has been certified as low risk, and has no greater chance of re-offending than any other citizen.
In other words, America’s registries consist almost entirely of Law Abiding Citizens. I know that if you are reading this, that’s certainly how you would describe yourself – whether you’re on the registry or not. It’s time for us to start calling the registry what it really is: The Law Abiding Citizens Registry.
