My Tier number is too high , could anyone tell me how I could fight it ?

How long till you have to register visiting Utah? Is it still 10 days?

@Catch22 – Can you let us know the reason you believe your Tier letter is incorrect? If you are right, there is an e-mail at the bottom of the Tier letter that states if you disagree, you should e-mail the DOJ at that e-mail address and advise them why you believe the assigned Tier is not correct.

Nelson v. Town of Paris, No. 22-2435 (7th Cir. 2023)

In 2008, Paris, a small, rural Kenosha County, Wisconsin community, enacted its “Sex Offender Residency Restrictions” ordinance, limiting where certain designated sex offenders could live within the town. The ordinance prohibits designated offenders from living within 6,500 feet of certain protected locations where children are known to congregate and prohibits designated offenders from living within 6,500 feet of any other designated offender Nelson, a former Paris resident and designated offender, was cited for violating the ordinance’s designated offenders restriction. His suit under 42 U.S.C. 1983, argued that the ordinance—both facially and as applied—violated his constitutional right to substantive due process and Article I’s prohibition on ex post facto laws.

The Seventh Circuit affirmed, in part, summary judgment in favor of Paris, noting that Nelson conceded that the “protected locations” ordinance is rationally related to Paris’s legitimate interest in protecting children. Paris’s restriction prohibiting designated offenders from living within 6,500 feet of protected locations does not violate the Constitution’s Ex Post Facto Clause because it is not “so punitive either in purpose or effect” as to negate Paris’s nonpunitive intent for the restriction. The court remanded the question of Paris’s restriction prohibiting designated offenders from living within 6,500 feet of each other.

The ordinance prohibits designated offenders from living within 6,500 feet of certain protected locations where children are known to congregate. Apparently this was ruled ok by the 7th circuit

@Disgusted In Michigan. Politicians repeat the lie into truth. We all know that. How can they be overturned, when they simply use the lie as fact. Our federal court said SORA is punitive. There has to be legal verbage to impede the slight of hand passing of a new SORA. I understand that the 6th only ruled on certain items, but if the Honorable Robert McClellan was able to go so far, why not finish the damn game. The two judges I knew, were not afraid to rule against the norm or be swayed by public influence. Perhaps he knew only so much could be tolerated. Thought the 6th was gonna make more history than circles.

I always have a concern for my safety when people like MTG are on Newsmax stating that a man on average pays for sex 7,200 times with a minor. Well, if my number of times is 0, then someone else must have paid for 14,400 times to make this average work.

Lies by people are what put us in danger.

The case of the Camp Pendleton Marine being accused of sexual assault is sounding more and more like a no-win scenario for this guy:

Dating platforms will not protect you from a sexual assault charge. You have to be your own advocate and protector when it comes online romance. In this situation (hooking up for casual sex), my advice, if I may borrow a phrase from War Games, is this: “The only winning move is not to play.”

Is anyone a Florida resident who is required to register per federal SORNA but not allowed to register in the state? If yes, have you had any federal agents question you about it? Do you know how the state’s determination to not register you jives with their statue that requires registration if you’re required to register in “any jurisdiction” (assuming by virtue of the SORNA statue)? Indiana also has the “any jurisdiction” clause in their statue, but their courts constructed “jurisdiction” as not invoking SORNA (still in appeals status years later). Has there been a similar ruling in Florida’s mud-puddle law?

This is a California question. Is the loss of privacy punishment in CA?

California Constitution, Article 1, Section 1: “All people are by nature free and independent and have inalienable rights. Among these are enjoying and defending life and liberty, acquiring, possessing, and protecting property, and pursuing and obtaining safety, happiness, and privacy.

Privacy is an inalienable right in California.

CA Voter Guide Information for 1972, General Election discusses about Right to Privacy as Proposition 11, starting on page 26 (or page 25 of the PDF file index). Key points in discussion:

  • The right to privacy is the right to be left alone.
  • Fundamental to our privacy is the ability to control circulation of personal information.
  • Even more dangerous is the loss of control over the accuracy of government and business records on individuals.

Just be reading the reasons for Prop 11 (right to privacy), it dictates the loss of privacy is a loss of an inalienable right. An individual can lose that inalienable right while being incarcerated (in custody), but the moment a person is no longer under custody, then that individual regains their civil rights!

I guess it doesn’t matter what category the loss of privacy is because an individual is guaranteed the capacity to pursue and obtain privacy, or rather the ability to be left alone. The registry doesn’t allow this avenue at all with any lifetime registration, which is CA Constitutional right.

To conflate the loss of privacy is the accuracy of records on individuals is also not being adhered to with individuals who have earned the 1203.4, granting they are no longer convicted of a crime and their accusation/information dismissed. The non-criminal registration agency does not recognize the granting of benefits of 1203.4 as it disseminates legally false information that an individual is convicted of a sex crime.

The registry is a civil rights abomination when “right to privacy” was amended into the CA Constitution in 1972. It doesn’t matter if it’s punishment or a penalty. What does matter is that an individual has the right to pursue and obtain privacy, the right to be left alone and the right to have accurate information the very moment a defendant is no longer under custody as well as if the defendant has also earned the 1203.4 granted benefit.

Registrants should not be excluded from CA’s “right to privacy” as written in the CA Constitution. Loss of that right is both punishment and a penalty in CA. The CA Constitution is to protect CA civil rights, but it is obvious it is not extended to the registrant class. The CA Constitution is on our side, but why are legal beagles afraid to touch it?

Patrick Henry once said, “Give me liberty or give me death.” The 1972 right to privacy amendment is supposed to give us liberty after paying our dues to society. The registry doesn’t give either relief, but rather castigates us as living zombies, continually excluding the registrant class from equal relief while increasing the burdens.

Is the CA Constitution just a bunch of words or does it actually protect ALL of its citizens?

For whomever it might help, here is the email that I have sent when requesting permission to go into school property to attend community meetings, Mayor’s State of the City presentations, etc.:

Couple things for the population here:

Those in California who are going to be inundated with this deluge of rain from the tropical storm, may you be able to get through it safely and without incident.

The other thing is regarding GPS trackers, ankles is only the start because now I’m reading that electric vehicles will be taxed via GPS trackers since they don’t use gas and gas taxes are a major source of revenue for infrastructure. We all knew that was coming.

One things for sure, the more I read various cases on registration, the more I see its complete Bull*hit. I read Wallace, which is important, then I read others who tried to use his case such as Kevin Ammons and the judge felt differently and said he should be a svp under newer laws even though the guy was convicted back in 1988! The bottom line is the judicial system in the Us is a joke and when it comes to one on the registry, they can ignore anything they want no matter how unjust the ruling is.

Fundamental to an understanding of the social hysteria surrounding “sex offenders” is a comprehension of the political environment in which it takes place and which makes it possible. No, people entrenched in particular ideologies are rarely persuadable by reason and arguments waged in an attempt to change their minds unproductive, but politics are central to the unreason and injustice we now face. Politics are why we face those challenges. They cannot be separated from them.

Omg you guys, my birthday is the 24th, so I went to register today Monday morning the 21’st and was notified that I am officially a Tier 1 registrant and can file my petition for removal!!! I couldn’t be happier and wanted to share that with you guys. I’m still in shock and can’t really believe it. I figured I would be un-tiered forever due to being convicted in Federal court. Tears of joy!!!!

And the punishment continues…. I broke up with a woman two years ago. I haven’t heard from her in almost a year. It came to my attention she is now dating a friend of mine son. He is a psychopathic drunk prone to violence. She divulged my registry status from 12 years ago to him. I was convicted of a single felony for a single nude photo of a possible 17 year old. Plea agreement made. Because I downloaded the photo using eMule I was charged with distribution. This psycho is now leaving threatening voice mail, horrible text and saying he will spread my registry status on social media. He claims I hurt my ex-girlfriend now he is going to hurt me. And they say this isn’t punishment. We will never be safe

Without getting too specific, there’s currently a lawsuit against Google for how YouTube censors the “modern day public square.” I haven’t yet seen or read the Complaint but its outcome will almost certainly shift our ability to fight Governments’ blacklisting PFRs on social media.

X, née Twitter, has already more than once been a battleground on this topic, with courts finding public officials cannot ban/block constituents. Hopefully this pending case yields similar results!

Any registrants successfully traveled to Italy in the last few months? I’ll be traveling there in October. I was denied entry in the UK in May. I just don’t want to experience this again. It wasn’t fun. I’ve tried to get an answer from the Italian Consulate in Miami and they say that it’s ultimately up to Passport Control.

I completely understand why Janice does what she does for us and many others like us. I wish I could donate $5K a month to help this cause, because kinda-like-you-kinda-like-me, we all see through the smoke and mirrors when it comes to draconian legislation that seems to keep getting worse as time goes on.

I will say this; I am 100% guilty of the offense that I committed that brought me into this realm of the criminal justice system. I attended the SOTP for 7 years, the entire time I was on probation, because the counselor didn’t want to “complete me” from the program because I had an outstanding balance with the court for fees, all-the-while continuing to charge me $25 per week for 3 additional years unnecessarily.

When I make comments on here, I am commenting with my capacity as a, “first-person”, as how I would be expected to handle my personal situation, because I am the one who got myself in this position in the first place. Therefore, I face this head-on, relying on the current legislation and hoping, like all of you, for some serious changes.

I read many comments here where the author blames everything else under the sun for having to participate in a system that we all know doesn’t do squat to protect the public. That has been proven over and over again.

The greatest way to show that we are truly not a danger to anyone, would be to accept the fact that we are the only one responsible for the acts that we’ve committed, because to sweep it under the rug only presents the opportunity to repeat history.

Please don’t hate me for being one to take responsibility for the damage that I have done to my victim’s life. This isn’t grade school and there are no do-overs. I cannot take back anything that I have done, and there is no manner of assistance that I can provide that will psychologically help my victim, even up to me dying won’t help.

I know this from personal experience, because every person who abused me as a child has died, and it hasn’t changed my psychological issues resulting from my abuse at all. The damage done is for life. I don’t touch people and I don’t allow people to touch me. While I am only 56 years old, I remain celibate and have now for 17 years.

I have never posted these statements anywhere else before. I hope this approved for posting by the moderator, because I believe we can all achieve the end goal by owning our offense.

Yesterday I met guy who just got out of prison after serving 4.5 years for a 290 conviction and was required to were a GPS tracking device for the next 3years wile on parole, he’s a Tier 2.
When he went to prison his wife and kids moved back to the Philippines, So he had no one.
You’d think that would be enough punishment BUT nope the State of California has one more sick and twisted punishment left for this poor guy, Because of his age he won’t be able to petition to get off the registry till he’s 70 but he was still in good spirits, At first I was amazed at how positive he was about the whole situation, BUT then I realized he was new to the registry and didn’t truly know the hardships that lies ahead for him.

My husband was removed from the state registry. Homefacts still lists him on as registered. I have tried to report the error but keeps coming up an error has occurred when I hit enter no matter what I do. Anyone have suggestions?

I am posting this here for all to be aware of phone searches. CBP will do so because they can with the courts saying they can. Others, not so much but in the end they do seem to win. There are updates to this probably but it is still good info.

I truly believe that every single person on any public registry in this country should file the largest class-action lawsuit ever known to mankind, detailing how we all have now been placed into a special class of people exactly the same as the Jewish people were years ago.

Crimes against humanity cannot continue, I don’t care who your government is.

I have gotten off the Registry in CA and now to volunteer at a Church I need to get a DOJ report based on my fingerprints.. does anyone know if it will reveal my twenty year old 664/288(a) conviction in CA? Anyone with experience or how to check what the DOJ report will say about me
