Uh, that’s how a pardon should work. It is rather idiotic for law enforcement and a state judge to think otherwise. Moreover it is unfortunate that this case took so long to resolve by making it to the Georgia supreme court. Thankfully the court made the logical conclusion and moving forward hopefully no one else who is granted a pardon by the parole board or any other entities with pardon granting power will face the same issues.
So …… we can all apply for these pardons? (And he did only 2 years on a 10-year sentence?? WTF??) My conviction was in Florida for a much less serious crime, but even if I was Mother Teresa, Ghandi, and MLK rolled into one, that State would never grant such a pardon. (Or is it simply a matter of a large campaign contribution to the right politician?)
