IN: COA reinstates petition to get off sex offender registry

A man’s petition to remove his name from the Indiana Sex Offender Registry was reinstated Friday when an appellate panel concluded that the trial court that dismissed the petition had jurisdiction to consider it.

In 1989, Stephen Peele was convicted of several felony child molesting charges and was sentenced to an aggregate 12 years in the Indiana Department of Correction. Then in 2003, Peele was convicted of Class C felony sexual misconduct with a minor. At some point, Peele was notified that he was required to register as a sex offender for 10 years.

According to Peele, he was notified in a letter from the DOC in 2007 that he was considered a “sex and violent offender” and required to register for the remainder of his life. Full Article

The late Judge Matsch made the same observation concerning a removal judge declining to act right concerning which party bore the burden of proof. That circuit judge had placed the removal burden upon the registrant to prove the unprovable. Matsch pointed out, under such a standard no body leaves alive. That is the very definition of authoritarianism by rule of law.
That is the advantages wrought by databases first promoted as safety registries. IMO, the delay tactics are probably purposefully engaged in to avoid scrutiny by the public. Better to suffer Admonishment than lose election to judgeship in county seat.
160k -190k in my state for that gig. CA gotta be far more $ than that.

What I wonder is where one can find an example of how to get off the registry by petition in Indiana. You can look online and find countless examples on how to write petitions for other crimes in Indiana, but not one for people on the registry. I called a lawyer and he said he’d charge 5k to do it and he’d recommend a psychologist to make it look even better for another 5k. Who has 10k just to possibly hear a “no. Try again next year!!!???”
