A 14-year-old New Jersey girl is facing child pornography charges for posting almost 30 nude photos of herself on MySpace. If she is convicted, the girl may have to register as a sex offender.
According to The Daily News, this case is just one example of a larger effort by law enforcement officials across the country to crack down on child pornography. Prosecutors now routinely bring charges resulting from kids sending nude photos to one another over cell phones and e-mail. This case may be unique in that it is the first one where charges were filed based on a teen posting photos on a social networking site. Full Article

If sex offender laws were created to protect “children” from sex offenders, then why is a child in danger of becoming a sex offender? There is no victim here therefore there is no crime. N’est-ce pas?
Why not? This is no more absurd than putting the 20-year old young man from South Carolina in prison for a year and a half and on the registry for life for taking a video of himself and his legal-age girlfriend, with her knowledge and consent.
At the end of the day, the law is the law. I have a big problem with selected enforcement of the law. Just like the parks ordinance in Huntington Beach.
If the law turns out to be bad and backfires – change it, at least for the future. Or don’t pass stupid laws in the first place!

I’m almost surprised they didn’t go after MySpace for possession of child pornography. After all, if the photos were on the computers in their possession, isn’t that possession of child pornography? After all, if my daughter were to take nude photos of herself and store them on my computer unbeknownst to me, then it was later found the photos were on MY computer, I would be arrested and charged.
