WI: Family Says City’s Sex Offender Law Goes Way Too Far

MILWAUKEE (CN) — Prosecuted as an adult when he was 17 for having sex with another teenager, a married man with three children has been sleeping in his truck since a Milwaukee suburb forced him out of his house because he’s a sex offender, he says in a constitutional complaint. Full Article

Sounds like Franklin is trying to keep up with New Berlin..and is getting its a$$ sued, just like New Berlin should. Both have the blatantly unconstitutional Original Domicile clause. Heck, were it that easy to keep “those people” out, the Florida (among others) legislature would have done it long ago!

    • AlexO

The problem is that almost everything is seemingly legal until its not. It takes a lot of strength to call out BS like this and follow through. Most people are too beat down to take real action. It’s why Janice and people like her are so amazing. They fight the fight that most can’t.

      • Guy

Exactly — we often have clients say, regarding the police or authorities, “They can’t do that!”

Well, point of fact, they did do that. The question then becomes, can they get away with it? The answer to that question all too often hinges on whether someone has the resources and the wherewithal to hold them to account.

  2. AlexO

I hope they win and get enough money to bankrupt the city.

  3. ReadyToFight

I can’t Stand reading crap like this.
You Really want someone to bare their teeth, keep pushing us…
    Good luck to this Family.
Maybe we should start a Go Fund Me.

  4. New Person

Makes you question… is this intent regulatory or punishment? Key word: Banned.

    • David

@ New Person: It could well be argued that the “effect” of the law matters more than its “intent”.

      • AJ

Indeed. Intent will always be a waste of time argument, because all any legislative body has to do is insert, “it is the intent of this body…” and the courts go, “oh ok,” with no questions asked. I understand the reasoning behind that, but it really makes rational basis review a one-, not two-, prong test: effect.

        • David

Yes, happily, the “intent” of the Pennsylvania legislature did not manage to convince their State Supreme Court!

  5. Ron

Besides the rso having his rights violated, I wonder if the family has had their rights to live with their father violated. – or being denied care from the father.

  6. The Unforgiven

“Prosecuted as an adult when he was 17 for having sex with another teenager..” 17 ? If ruining a ‘child’s’ life is saving ‘just one child’, do they cancel each other out and it’s all for naught?

    • AJ

      @Unforgiven
If you stress the words correctly, they did exactly what they like to claim: they saved *one* child…and hung the other one out to dry.

  7. Commenter1

Judge in the case granted a preliminary injunction today!

  8. Nondescript

If ever there was an aspect of these asinine laws that scream out cruel and unusual – it is this. Separating a free person from their family and friends because of an arbitrary line on a tape measure, should be proof enough to any sentient human that whoever is actually pushing for these laws is severely compromised, scared and just following orders to save their careers.

This story is probably being put out there preemptively, because they already plan on changing things in Milwaukee . I think residency restrictions across the country are going to be a thing of the past as you can see the dominos lining up. This guy will prevail. And the spouses in these situations should sue for loss of consortium when these laws finally do get overturned.

  9. kind of living

this is a very sad story but it is more than just sad it also shows how cold and dirty not just the law makers are but how phony so many of these people that insist they need these laws to “feel safe” but I have to say this , I think we have been pushed so many times by so many regulations/laws that it looks clear that the powers that be are pushing us tell one or more nut up and retaliate in a really negative manner so they can say look! see these people are out of control ! and they all need to be locked up , and never even talk about hard we have been pushed , so I am in hopes that everyone stays on track and positive that we will over come these unjust laws , in a positive manner , you can bet that if all people were treated like the RC the out come would be madness on an epic level , I commend all RC’s and there familys for being civilized in the handling of what is clearly an attack on human rights , we are taking the fight to them in a nonviolent hopeful way wishing no further harm on anyone , not asking for anything extra , just our right to move on in our lifes in our pursuit of happiness , I wish nothing but positivity for this family as well as all that have been affected
