Federal appeals court upholds judge’s lowest possible sentence in child-porn case

    Lowest possible sentence? That is an incorrect statement. The lowest possible sentence would have been no prison time. I know of someone who had two years of house arrest and probation at the same time plus a few years afterwards. Who knows what the actual lowest sentence could have been, but that certainly was not it.

      Actually this Ohio man got VERY lucky getting only a year especially for the level of his crime. He had 1500 images plus he was file-sharing. Under federal guidelines, distribution of CP is a mandatory minimum of 5 years. Just mere possession of CP is an automatic 3 years here in Wisconsin.

      This Ohio man could have easily gotten 20 years under some state laws. One guy in Florida is serving a life sentence and he had far fewer images.

      I assume the person you know committed his offense in California which is one of the most lenient states in the nation when it comes to CP. Your friend should thank his lucky starts he didn’t get caught in a southern or Midwestern state. I also heard Connecticut is pretty hard on CP offenders
