CA Senate Bill 1128 was stopped today during a hearing conducted by the Assembly’s Appropriations Committee. The committee did not provide a reason for stopping the bill, but it has been reported that strong opposition to the bill by ACSOL and its leaders was an important part of that decision.
“ACSOL thanks every person who showed up at the committee hearing on July 2, who sent a letter to the committee and who called committee members,” stated ACSOL Executive Director Janice Bellucci. “You made a difference by showing up, standing up and speaking up.“
If Senate Bill 1128 had passed, up to 32,000 people could have been added to the state registry, according to statements made during a recent meeting of the CA Sex Offender Management Board. That is because everyone convicted of Penal Code Section 261.5, unlawful intercourse with a minor, with an age gap of 10 years or longer would be required to register for the first time even if their conviction took place long ago.
Due to the committee’s decision today, Senate Bill 1128 will not move forward in the legislature for further consideration. Therefore, the Governor will not be asked to sign the bill.
“This is a significant victory for thousands of people who could have been added to the registry,” stated Bellucci. “We thank the Appropriations Committee for making the right decision today.“

When this bill passed the Public Safety Committee, it was stated that it would not be applied retroactively. Based on this post, it seems that had it been signed into law, it WOULD have been applied retroactively. Which is correct?

Great news, and I hope that when the Legislature (hopefully considers moving non-violent “no-touching” crimes from Tier Three back to Tier One, such a move can be justified by pointing out that those who have had actual sex with minors don’t have to register at all.
Have to have money to make an appropriations bill applicable for a law you’re trying to put into place. If you don’t have the money because you’re highly in debt as a state already, it doesn’t matter how many votes it gets, the money is not there, it’s not going to go anywhere.
Fantastic news! This is hopeful for the coming reasons of fixing and then axing the registry.
Our next step is to name each legislator who was backing this bill and then remove them from office either via recall or by voting them out in the next election. YES. We can do this!!!
I still do not get this? How can someone get a 288(a) or (c) and be on registry and not if you had intercourse instead?
What are the odds some state official would have had a family member or friend caught up in this and worked to get it killed
